Adopting the 2025 Operating Plan for the Comprehensive Downtown Improvement Special Service District and imposing a service charge pursuant to Minnesota Statutes Chapter 428A. (Public hearing closed and laid over from July 17, 2024)

WHEREAS, pursuant to Minnesota Statutes Chapter 428A (the “Act”), and upon petition from downtown property owners, the City Council will consider final adoption of Ordinance No. 24-17 ("Enabling Ordinance") on July 24, 2024, which will create Chapter 143 of the Saint Paul Legislative Code (Title XII) and therein establish the Comprehensive Downtown Improvement Special Service District (the “District”); and
WHEREAS, in accordance with Section 428A.08 of the Act, owners of at least 25 percent of the land area of property that would be subject to service charges in the District, and at least 25 percent of the individuals and business organizations subject to a service charge imposed on a basis other than tax capacity filed petitions with the City Clerk to establish the District; and
WHEREAS, Section 143.02 of the Enabling Ordinance provides that each year the City Council will adopt by resolution an operating plan and budget (“Operating Plan”) for the District; and
WHEREAS, through its board of directors the District has prepared and approved the 2025 Operating Plan, as provided in Exhibit A attached hereto; and
WHEREAS, on July 17, 2024 the City Council conducted a public hearing, duly noticed in accordance with the Act, regarding imposition of the proposed 2025 service charge to finance the services provided in the District in accordance with the Operating Plan; now, therefore, be it
RESOLVED, that the City Council hereby adopts the 2025 Operating Plan for the District; and
BE IT FURTHER RESOLVED, that the proposed service charge calculation summary, as provided in Exhibit B attached hereto, and the proposed service charges for each affected property for calendar year 2025, as provided in the Assessment Roll attached hereto as Exhibit C, in the proposed total amount of $2,724,706.90, as on file in the Office of the City Clerk, are hereby approved for the District; and
BE IT FINALLY RESOLVED, that the City Clerk, through the City’s Financial Services Real Estate Section, is hereby directed to transmit certified copies of said service charges listed in the Assessment Roll to Ramsey County to be collected on the 2025 real estate tax statements without interest and in the same manner as special assessments.
