Resolution authorizing execution of a Garden License Agreement with Thomas-Dale/District 7 Planning Council, Inc. for use of 19 Como Avenue, District 7, Ward 1

Body

 

WHEREAS, the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota (the "HRA") is a public body corporate and politic established pursuant to the provisions of Minnesota Statutes, Section 469.001, et seq. (the “Act”); and

WHEREAS, the HRA has the power to engage in development or redevelopment activities under Minnesota law and the HRA is authorized to engage in activities relating to (a) housing projects and development, (b) removal and prevention of the spread of conditions of blight or deterioration, (c) bringing substandard buildings and improvements into compliance with public standards, (d) disposition of land for private redevelopment, and (e) improving the tax base and the financial stability of the community, and to engage in the aforementioned activities when these needs cannot be met through reliance solely upon private initiative and which can also be undertaken in targeted neighborhoods; and is authorized to create redevelopment projects as defined in Minnesota Statute Section 469.002, Subd. 14; and

WHEREAS, the HRA is the owner of a vacant lot at 19 Como Avenue, Saint Paul, Mn  (“Property”); and

WHEREAS, Thomas-Dale/District 7 Planning Council, Inc. (“District 7”) has requested the use of the Property for gardening purposes under a three year license agreement (“License Agreement”) in the form approved by HRA staff; and

WHEREAS, HRA does not currently have plans for development of the Property; and

WHEREAS, District 7 will handle all maintenance of the Property; and

WHEREAS, the HRA Board determines that there is proper public purpose to approve the License Agreement.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota, that:

1.                     The HRA Board hereby approves the License Agreement in substantially the form submitted to this Board for consideration and the HRA Chair/Commissioner is hereby authorized and directed to execute the License Agreement. 

2.                     The Executive Director of the HRA and HRA staff are hereby authorized and directed to take all necessary action to effectuate this Resolution, and the Executive Director is authorized to execute any further documents in connection with the License Agreement.
