Waiving the 45-day notice requirement to approve a Liquor Outdoor Service Area (Sidewalk) license with existing Liquor On Sale - 100 seats or less and Liquor On Sale - Sunday licenses held by Hogan Bard LLC d/b/a Emerald Lounge (License ID # 20210000674) for the premises located at 455 7^th Street West in Saint Paul.

Body

WHEREAS, Hogan Bard LLC d/b/a Emerald Lounge (License Group ID # 20210000674) applied for a Liquor Outdoor Service Area (Sidewalk) for the premises located at 455 7^th Street West in Saint Paul; and 

WHEREAS, The Licensee currently holds a Liquor On Sale - 100 seats or less and Liquor On Sale - Sunday license and

WHEREAS, licensee was required to seek support from a list of private residences, dwellings and apartment houses within a 300-foot radius of licensee's proposed Liquor Outdoor Service Area (Sidewalk) license at 455 7^th Street West that was provided by the Department of Safety and Inspection by signatures of approval on petitions; and

WHEREAS, licensee sought support from a list of private residences provided by the Department of Safety and Inspection by signatures of approval on petitions; and

WHEREAS, records indicate the licensee had obtained twenty-five (25) out of fifty-four (54) possible petition signatures for forty-six percent (46%) in support of adding a Liquor Outdoor Service Area (Sidewalk) license per City of Saint Paul Legislative Code 409.06(g) (2) (c); and

WHEREAS, licensee was unable to obtain the ninety percent (90%) consent or, in the lesser case, sixty percent (60%) or more; and

WHEREAS, the licensee submitted a “good faith” letter outlining his attempt to attain signatures required by the City of Saint Paul from residential property owners; and

WHEREAS, The Department of Safety and Inspections received a letter from West 7^th/Fort Road Federation on June 27, 2022 in support of waiving the 45 day notice requirement and the addition of an Liquor Outdoor Service Area (Sidewalk) license to the existing licenses; and

WHEREAS, in response to the July 28, 2022 notification from the Department of Safety and Inspections regarding the license application, the City received no objections to add the Liquor Outdoor Service Area (Sidewalk) license; and

WHEREAS, the Council finds that issuance of the license will not interfere with the reasonable use and enjoyment of neighboring property and residences and will not bear adversely on the health, safety, morals and general welfare of the community; now, therefore, be it,

RESOLVED, a waiver of the 45-day notice requirement is granted and the Liquor Outdoor Service Area (Sidewalk) License are hereby approved and issued to Hogan Bard LLC d/b/a Emerald Lounge (License Group ID # 20210000674) for the premises located at 455 7^th Street West in Saint Paul.
