Stated Reason for Appeal (if given): Property owner (PO) states auto pay payments were being declined despite having given WM updated credit card information. PO also states they were not properly notified about declined payments, resulting in late fees and an assessment. PO believes late fees should be removed.

Staff Comments: WM states they emailed property owner on January 25 with a notification about the declined auto pay, and property owner did not contact WM until early April. However,  PO states they contacted WM in October 2023 with updated credit card information. The Q4 payment was entered as a one time payment. WM did not update the auto pay at the same time. WM sent three NNPs to property address in Q1. PO has 96 Gallon cart at $134.31 quarterly. Late fee total is $20.13

WHEREAS, the Office of Financial Services Real Estate Section has attached to this Council File both a report of completion outlining the costs and fees associated with Collection of Delinquent Garbage Bills for services during January to March 2024. (File No. CG2402A1, Assessment No. 240113) and the assessment roll including all properties for which these assessments are proposed for Council ratification; and

 

WHEREAS, the City Council’s Legislative Hearing Officer has reviewed an appeal of this assessment and developed a recommendation for the City Council with respect to this assessment; and

 

WHEREAS, a public hearing having been conducted for the above improvement, and said assessment having been further considered by the Council and having been considered financially satisfactory; Now, Therefore, Be It

 

RESOLVED, that pursuant to Chapter 14 of the Saint Paul City Charter, said assessment is hereby ratified and reduced from $154.44 to $134.31.
