Approving the Liquor On Sale-100 seats or less, Liquor On Sale-Sunday, Liquor-Outdoor Service Area (Sidewalk) and Entertainment (A) licenses for Abyssinia General Trading LLC d/b/a Erta Ale Ethiopian Restaurant (License ID 20230000687) for the premises located at 308 Prince Street, Suite #140.

WHEREAS, Abyssinia General Trading LLC d/b/a Erta Ale Ethiopian Restaurant (License ID 20230000687) applied for a Liquor On Sale-100 seats or less, a Liquor On Sale-Sunday, a Liquor-Outdoor Service Area (Sidewalk) and an Entertainment (A) license for the premises located at 308 Prince Street, Suite #140 in Saint Paul; and
WHEREAS, on May 31, 2023, the Department of Safety and Inspections sent out the required License Application Notification; and
WHEREAS, in response to the May 31, 2023, notification, the Department of Safety and Inspections received no objections to approval of the licenses; and
WHEREAS, the Council finds that the application is in order, the proposed license conditions are reasonable and there are no grounds to deny approval of the licenses; now, therefore, be it,
RESOLVED, the Liquor On Sale-100 seats or less, Liquor On Sale-Sunday, Liquor-Outdoor Service Area (Sidewalk) and Entertainment (A) licenses are hereby approved and issued to Abyssinia General Trading LLC d/b/a Erta Ale Ethiopian Restaurant (License ID 20230000687) for the premises located at 308 Prince Street, Suite #140 in Saint Paul with the following license conditions:
1. Per City of Saint Paul Legislative Code 411.02, the definition of Entertainment A is, "Amplified or nonamplified music and/or singing by performers without limitation as to number, and group singing participated in by patrons of the establishment." (includes karaoke). Entertainment A license does not allow for patron and/or performance dances.
2. Licensee agrees to limit the placement of table(s)/chair(s) on the public sidewalk to the area and number of seats shown on the approved sidewalk seating plan on file with the Department of Safety and Inspections (DSI) and Public Works.
3. Each year prior to the placement of table(s) and/or chair(s) in the public right-of-way (i.e., sidewalk), the licensee agrees to obtain a new Obstruction Permit from the Department of Public Works. Licensee agrees to maintain the sidewalk cafe in accordance with the conditions placed on an approved Obstruction Permit, acknowledges that an Obstruction Permit is effective on April 1 and expires on October 31 of each year, that table(s) and/or chair(s) may not be placed in the public right-of-way before or after the effective/expiration dates, and that failure to comply with this condition will result in adverse action being taken against all of their licenses.
