Title

Approving the application for a license approval for GB License LLC d/b/a Gopuff for the Liquor Off Sale (License ID #20230002311) for the premises located at 129 State Street. (Laid over from September 18, 2024)

WHEREAS, on December 18, 2023, GB License LLC d/b/a Gopuff (License ID #20230002311) applied for a license approval to the Liquor Off Sale license for the premises at 129 State St., in Saint Paul; and

WHEREAS, the license application notification was sent out by the Department of Safety and Inspections (DSI) on August 21, 2024, with a response date of September 5, 2024; and

WHEREAS, in response to the notification no objections or comments were received; and

WHEREAS, the Council finds that the application is in order and there are no grounds to deny approval of the license; now, therefore, be it,

RESOLVED, the license application approval for the Liquor Off Sale license is hereby approved and issued to GB License LLC d/b/a Gopuff (License ID #20230002311) for the premises located at 129 State St., in Saint Paul with the following existing license conditions:

1.)                     Per State of Minnesota Statute 340A.412, Subd. 14) - a licensed liquor off-sale establishment ( i.e., liquor store) may sell only items including the following: alcoholic beverages, ice, beverages for mixing with intoxicating liquor, soft drinks, liqueur-filled candies, food products that contain more than one-half of one percent alcohol by volume, cork extraction devices, books and videos on the use of alcoholic beverages, magazines and other publications published primarily for information and education on alcoholic beverages, and home brewing equipment.

 

2.)                     Alcohol deliveries will be completed by agents of GB License LLC, which is permissible in accordance with existing Minnesota Department of Public Safety precedent. GB License LLC will remain legally responsible and liable for the conduct of its agents related to the delivery of alcoholic beverages, including ensuring compliance with all obligations related to the prohibitions on sales to minors and sales to intoxicated persons as well as all record-keeping requirements.

 

3.)                     GB License LLC will follow their Compliance Program as related to the sale and delivery of alcohol as presented in their Business Plan in their license application; including but not limited to Responsible Delivery. Any changes to the Program will require approval by the Department of Safety and Inspections prior to implementation.
