Approving adverse action against the Solid Waste Hauler & Vehicle license held by All Star Rolloff, Inc., d/b/a All Star Rolloff, Inc.

 

Body

WHEREAS, the Solid Waste Hauler & Vehicle license held by All Star Rolloff, Inc., d/b/a All Star Rolloff, Inc. (License ID #20100000366) for the City of Saint Paul, was the subject of a Notice of Intent to Suspend License dated November 8, 2013, alleging licensee failed to schedule an inspection of his vehicle, pay delinquent license and late fees of $517.00, and submit the following information: 1) current certificates of General and Auto Liability insurance; 2) a current Schedule of Charges and 3) a completed Certificate of Compliance Minnesota Workers' Compensation Law Form; and 

 

WHEREAS, per Saint Paul Legislative Code §310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required information in order to maintain the license; and  

 

WHEREAS, on November 13, 2013, the licensee responded to the Notice of Intent to Suspend License stating that he had been trying to schedule a vehicle inspection but has not been able to reach an inspector; and

 

WHEREAS, on November 14, 2013, the licensee called the DSI inspector to say his driver was downstairs, but when the inspector went to do the inspection the driver was not in the area; and

 

WHEREAS, on November 14, 2013, a DSI inspector called the licensee back to explain he needed to pay his delinquent license and late fees before his vehicle inspection and gave him an opportunity to re-schedule the vehicle inspection; and

 

WHEREAS, the licensee has failed to follow-up with DSI to pay the delinquent license and late fees and re-schedule his vehicle inspection; and

 

WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to pay the delinquent license and late fees, schedule his vehicle inspection, submit the required information, request a hearing or cancel his license by November 18, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it

 

RESOLVED, the Solid Waste Hauler & Vehicle license held by All Star Rolloff, Inc., d/b/a All Star Rolloff, Inc. is hereby suspended for failure to pay delinquent license and late fees of $517.00 and schedule his vehicle inspection.

 

FURTHER RESOLVED, the licensee is ordered to pay a matrix penalty of $500.00 for failure to submit required information in order to maintain the license.

 

The license will remain suspended until all license fees and penalties are paid in full, his vehicle is inspected and all requested documents are submitted to the Department of Safety and Inspections.
