Approving adverse action against the Mobile Food Vehicle license held by Emma M. Lopez-Morales, d/b/a Border Tacos.

WHEREAS, adverse action was taken against the Mobile Food Vehicle license held by Emma M. Lopez-Morales d/b/a Border Tacos (License ID #20070004671) for the City of Saint Paul, by Notice of Intent to Suspend License dated January 23, 2013, alleging licensee failed to pay delinquent license and late fees of $364.00; and
WHEREAS, the licensee also failed to submit the following information:  1) current menu of ALL food items to be served from the licensed vehicle; 2) current letter of permission signed by the owner of your commissary allowing use of the facility as a commissary and state location of commissary; 3) the invoice sent to you with payment of license and late fees by check or money order only; 4) state location of food sales (w/site plan); 5) state location of vehicle storage (w/site plan); 6) list detailed vehicle information (VIN, license plate #, year, make and model and 7) a completed Certificate of Compliance Minnesota Workers' Compensation Law form; and
 
WHEREAS, per Saint Paul Legislative Code ยง310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required information in order to maintain the license; and   
 
WHEREAS, the licensee did not respond to the Notice of Intent to Suspend License to pay the delinquent license and late fees and submit the required information or request a hearing; and
 
WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to pay the delinquent license and late fees and submit the required information or request a hearing by February 4, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that the Mobile Food Vehicle license held by Emma M. Lopez-Morales d/b/a Border Tacos is hereby suspended for failure to pay delinquent license and late fees of $364.00.
FURTHER RESOLVED, the licensee is ordered to pay a matrix penalty of $500.00 for failure to submit required information in order to maintain the license.
 
The license will remain suspended until all license fees and penalties are paid in full and all required information is submitted to the Department of Safety and Inspections.
