Title
Authorizing the City through its Fire Department to amend a joint powers agreement with the State of Minnesota through its State Fire Marshal Division to provide a hazardous materials response team and amend the 2026 financing and spending plans for the Fire Department in the amount of $360,000.
Body
WHEREAS, pursuant to Minn Stat. Section 471.59, two or more governmental units, by agreement entered into through action of their governing bodies, may jointly or cooperatively exercise and any power common to the contracting parties or may provide for the exercise of such powers by one or more of the participating governmental units on behalf of the other participating units; and
WHEREAS, the State of Minnesota (the "State"), acting through its Commissioner of Public Safety on behalf of the State Fire Marshal division, and the City of Saint Paul (the "City"), acting through its Fire Department, executed a Joint Powers Agreement on September 16, 2022 (the "Agreement"), to provide incident command technical expertise in hazard identification and emergency response in a pre-identified geographic area; and
WHEREAS, the State wishes to amend the Agreement to reflect operations and payment updates pursuant to the Amendment 1, a form of which is attached to this resolution (the "Amendment" and, together with the Agreement, the "Amended Agreement");
WHEREAS, pursuant to the Amended Agreement, the State shall pay the City $360,000 for services performed from July 1, 2026 - June 30, 2027; and
WHEREAS, the Fire Department's 2026 financing and spending plans must be revised to account for change in payments under the Amended Agreement; and
WHEREAS, the Mayor, pursuant to Section 10.07.1 of the Charter of the City, does certify that there is available for appropriation, funds of $360,000 in excess of those estimated in the 2026 budget; now therefore be it
RESOLVED, by the Council of the City (the "Council"), that $360,000 is available for appropriation in the 2026 budget, and said budget as heretofore adopted by Council is hereby amended as outlined in the attached financial analysis; and be it further
