Approval of the execution and recording of a declaration for maintenance of stormwater facilities at the Hamm’s Brewery site, 694 Minnehaha Avenue East District 4, Ward 7
Body
WHEREAS, the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota (the “HRA”) is a public body corporate and politic established pursuant to the provisions of Minnesota Statutes, Section 469.001, et seq. (the “Act”); and
WHEREAS, the HRA has the power to engage in development or redevelopment activities under Minnesota law and the HRA is authorized to engage in activities relating to (a) housing projects and development, (b) removal and prevention of the spread of blight or deterioration, (c) brining substandard buildings and improvements into compliance with public standards, (d) disposition of land for private redevelopment, and (e) improving the tax base and the financial stability of the community, and to engage in the aforementioned activities when these needs cannot be met through reliance solely upon private initiative and which can also be undertaken in targeted neighborhoods; and is authorized to create redevelopment projects as defined in inn Stat Section 469.002, Subd. 14; and
WHEREAS, the HRA owns property at 694 Minnehaha Avenue East, Saint Paul, Minnesota (the “Hamms Property”); and
WHEREAS, there is currently no stormwater infrastructure in the public parking lot on the eastern side of the property, which has created challenges for adjacent properties, including the privately-owned 704 Minnehaha Avenue East; and
WHEREAS, in 2014, the HRA demolished 690 Minnehaha Avenue East, commonly known as “Building 1” at the Hamms Property; and
WHEREAS, the demolition of Building 1 triggered City requirements to provide additional stormwater management on the Hamms Property; and
WHEREAS; the HRA has designed a stormwater management system and is seeking permits from the City of Saint Paul and the Capital Region Watershed District for the installation of this system; and
WHEREAS; the Capital Region Watershed District requires a maintenance declaration be executed and recorded upon the property to authorize a permit for the construction of the stormwater management system; and
WHEREAS, it is in the public interest to install this proposed stormwater management system to fulfill stormwater requirements and address the stormwater management challenges to ensure the long-term viability of 704 Minnehaha Avenue East; and
NOW THEREFORE IT BE RESOLVED by the Board of Commissioners of the Housing and Redevelopment Authority of the City of Saint Paul, MN, that:
1. The HRA is committed in maintaining a stormwater management system upon installation at the Hamms Property.
2. The HRA Board hereby approves the execution and recording of a maintenance declaration for this stormwater management system.
3. HRA staff and legal counsel for the HRA are further directed and authorized to take all actions necessary to implement this Resolution.
