Title

Directing the City Clerk to notify the County Auditor to place a referendum of Ordinance Ord 25-2 on the November 4, 2025, ballot and approving the title and language for that ballot question.

Body

WHEREAS, all changes to the City Charter must be recommended by the Saint Paul Charter Commission, and

WHEREAS, the Saint Paul City Council by RES 24-1572 requested the Saint Paul Charter Commission to review, approve and recommend an amendment to Chapter 6.03 of the City Charter, and

WHEREAS, on December 12, 2024, the Charter Commission voted, 12 in favor and 3 opposed, to recommend Chapter 6.03.1 of the City Charter be amended, and

WHEREAS, the City of Saint Paul enacted Ordinance Ord 25-2 which amended Chapter 6.03 of the City Charter, and

WHEREAS, Minn Stat § 410.12 Subd. 7 provides that a charter amendment ordinance passed by the City Council may be subject to referendum by a petition filed within sixty (60) days after its publication, and

WHEREAS, residents timely filed a petition seeking a referendum to put Ordinance Ord 25-2 on a ballot for a citywide vote, and

WHEREAS, the City Council found that the petition was sufficient to satisfy the minimum signature requirements under Minn Stat § 410.12 Subd. 7, and

WHEREAS, Minnesota Statutes § 205.16 requires that the City Clerk provide to the County Auditor written notice of a ballot question, and

WHEREAS, the written notice must include the title and language for the ballot question, and

WHEREAS, the City Attorney has approved the title of the ballot question and has drafted language of the ballot question, now therefore be it

RESOLVED, that the City Clerk is directed to notify the County Auditor to place a referendum of Ordinance Ord 25-2 on the November 4, 2025 ballot, and be it

FURTHER RESOLVED, that the City Council adopts the title and the language of the ballot question as follows:

 

TITLE:  Referendum on whether Ordinance Ord 25-2 should take effect.

QUESTION:   Should Ordinance Ord 25-2, amending Chapter 6.03 of the St. Paul Charter, regarding Administrative Citations take effect?  Ordinance Ord 25-2 pertains to the application of Administrative Citations for violations of City Ordinances.  A “yes” vote is a vote in favor of amending the City Charter to allow the City to impose administrative citations and allowing Ordinance Ord 25-2 to take effect.  A “No” vote is a vote to not amend the City Charter to allow the City to impose administrative citations and not allow Ordinance Ord 25-2 to go into effect.
