Body
WHEREAS, the Auto Body Repair/Painting Shop license held by Duqueiro Cano d/b/a Duke's Cars & Towing (License ID #20120001127) for the premises located at 323 Maria Avenue in Saint Paul was the subject of a Notice of Intent to Suspend License and Notice of Violation dated July 23, 2014, stating the following: 1) the licensee failed to pay a $500.00 matrix penalty imposed by City Council on June 18, 2014 (RES #14-1028) and 2) during a re-inspection of the licensed premises on June 13, 2014, a DSI Inspector documented violations to license conditions #6, #7, #10 and #13;
 
WHEREAS, per Saint Paul Legislative Code ยง 310.05 (m) (1), the licensing office recommended suspension of the Auto Body Repair/Painting Shop license for non-payment of the $500.00 matrix penalty imposed by City Council and an additional  $1,000.00 matrix penalty for the June 13, 2014, license condition violations; and
WHEREAS, the licensee did respond to the Notice of Intent to Suspend License and Notice of Violation on July 28, 2014, to pay the $500.00 matrix penalty imposed by City Council, but failed to pay the additional $1,000.00 matrix penalty for the June 13, 2014, license condition violations or request a public or administrative hearing; and
WHEREAS, the Notice of Intent to Suspend License and Notice of Violation stated that if the licensee failed to pay the additional $1,000.00 matrix penalty or request a hearing by August 1, 2014, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Duqueiro Cano d/b/a Duke's Cars & Towing is hereby ordered to pay a matrix penalty of $1,000.00 matrix penalty for violations to license conditions #6, #7, #10 and #13 documented by a DSI Inspector during a re-inspection on June 13, 2014.    Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
