Approving a waiver of the 45-day notification waiting period in to approve a Wine On Sale and Malt On Sale (Strong) license with conditions to Krungthep Thai, LLC, d/b/a Krungthep Thai Restaurant Fusion & Grill (License ID #20170003477) at 1141 Rice Street.

WHEREAS, Krungthep Thai, LLC d/b/a Krungthep Thai Restaurant Fusion & Grill (License ID #20170003477) applied for Wine On Sale and Malt On Sale (Strong) license for the premises located at 1141 Rice Street in Saint Paul; and
WHEREAS, the licensee requested a waiver of the 45-day notification waiting period for approval of the Wine On Sale and Malt On Sale (Strong) licenses; and
WHEREAS, the Department of Safety and Inspections received an letter from District 6 Planning Council in support of waiving the 45-day notification waiting period and approving the Wine On Sale, Malt On Sale (Strong) licenses; and
WHEREAS, the Department of Safety and Inspections received no other objections to waiving the 45-day notification waiting period and approving the licenses; and
WHEREAS, the Council finds that the application is in order and there are no grounds for denial of the 45-day waiver and approval of the licenses; therefore, be it,
RESOLVED, a waiver of the 45-day notification waiting period is granted along with approval of the Wine On Sale and Malt On Sale (Strong) licenses to Krungthep Thai, LLC d/b/a Krungthep Thai Restaurant Fusion & Grill (License ID #20170003477) for the premises located at 1141 Rice Street in Saint Paul with the following conditions:
CONDITION #1 & 2 PER ZONING VARIANCE #15-126078 & SITE PLAN REVIEW #16-036351
1. Licensee shall maintain thirteen (13) off-street parking spaces on the property.
2. The licensee shall maintain the site in accordance with the approved site plan, which includes maintenance of the landscaping filter/visual buffer along the alley in good condition. Licensee acknowledges that the City reserves the right to require the property owner install a 4'6" high wood obscuring fence along the alley if the landscaping is no maintained in accordance with City requirements.
ADDITIONAL LICENSE CONDITIONS:
3. Per City of Saint Paul Legislative Code 409.15(a)(2), On-sale wine license shall mean a license authorizing the sale of wine not exceeding fourteen (14) percent alcohol by volume, for consumption on the licensed premises only in conjunction with the sale and service of food (menu item only). The sale of Malt (Strong) will also take place only in conjunction with the sale and service of food.
4. Per City of Saint Paul Legislative Code 409.15(e), licensee must be able to show that gross receipts are at least sixty (60) percent attributable to the sale of food.
5. Licensee will submit to the Department of Safety and Inspections (DSI) annual gross receipts for food and liquor for each year the license is renewed.
6. Licensee agrees to close the establishment at 12:00 a.m. midnight each day of the week. All patron/customers shall vacate the premises by 12:30 a.m. each day of the week as per City Zoning Code (parking requirement).
