Title
Waiving the 45-day notice requirement to approve Liquor On Sale - Sunday, Liquor On Sale 181-290 Seats, and Liquor - Outdoor Service Area (Sidewalk) licenses, and the addition of a new owner to the existing ownership group for The Green Mill Inn LLC, d/b/a Green Mill (License ID #20130003655) at 57 Hamline Avenue South.

WHEREAS, The Green Mill Inn LLC d/b/a Green Mill (License ID #20130003655) applied for a Liquor On Sale - Sunday; Liquor On Sale 181-290 Seats and a Liquor -Outdoor Service Area (Sidewalk) license; and
 
WHEREAS, the licensee also applied for a 45-day waiver to allow the addition of a new owner to the existing ownership group; and
WHEREAS, DSI received a letter from Macalester-Groveland Community Council approving the 45-day waiver and had no objections to the issuance of the Liquor On Sale - Sunday; Liquor On Sale 181-290 Seats and a Liquor -Outdoor Service Area (Sidewalk) license and addition of a new owner to the existing ownership group; and
 
WHEREAS, the Council finds that the application is in order and there are no grounds for denial of the Liquor On Sale - Sunday; Liquor On Sale 181-290 Seats and a Liquor -Outdoor Service Area (Sidewalk) licenses and addition of a new owner to the existing ownership group; now, therefore, be it,
RESOLVED, the addition of a new owner to the existing ownership group is hereby granted.
FURTHER RESOLVED, the Liquor On Sale - Sunday; Liquor On Sale 181-290 Seats and the Liquor -Outdoor Service Area (Sidewalk) licenses are hereby granted to The Green Mill Inn LLC d/b/a Green Mill (License ID #20130003655) for the premises located at 57 Hamline Avenue South with the following conditions:
1.      Sale of alcoholic beverages should be limited to 30% of total sales.  Green Mill will continue to utilize all of its tables for full menu service.
2.      Hard liquor service will terminate with the closing of the kitchen at 11pm on weekdays and midnight on weekends.
3.      No Happy Hour specials on hard liquor drinks.
4.      No expansion of bar seating--currently there are approximately nine (9) seats.
5.      No entertainment requiring a Class B license is allowed.  
 
6.      A Designated Driver Program will continue to be promoted within the restaurant.
7.      No dumping of glass and bottles into dumpsters by Green Mill cleanup staff before 7am and after 10pm.
8.      No pickup of trash and/or recyclables before 7am on weekdays or 9am on weekends.
Conditions 9 thru 13 added with request for the Liquor Outdoor Service (sidewalk) license
9.      Customers will not be seated at the outdoor sidewalk café after 8:30 PM and this outdoor café will be closed (unoccupied) at 9:30 PM.
10.      Each year prior to the placement of table(s) and/or chair(s) in the public right-of-way (i.e., sidewalk), the licensee agrees to obtain a new Obstruction Permit from the Department of Public Works.  Licensee agrees to maintain the sidewalk café in accordance with the conditions placed on an approved Obstruction Permit, acknowledges that an Obstruction Permit is effective on April 1 and expires on October 31 of each year, that table(s) and/or chair(s) may not be placed in the public right-of-way before or after the effective/expiration dates, and that a failure to comply with this condition will result in adverse action being taken against all of their licenses.
11.      No outdoor food and/or beverage preparation is allowed on a public sidewalk without prior approval and additional licensing from DSI.
12.      Failure to comply with any of these conditions may be grounds for adverse action.
      13.  Sidewalk seating is approved for a maximum of thirty-six (36) seats.
