Title

Final Order to consider the reconstruction of University Avenue between I-35E and Lafayette Road and acquisition of necessary property rights.

Body

IN THE MATTER OF reconstructing University Avenue between I-35E and Lafayette Road, including added signals, street lighting, trees, signs, concrete sidewalks and an off-street trail, and acquisition of permanent right of way easements, permanent sidewalk, drainage and utility easements, and temporary construction easements needed to accommodate the street reconstruction. 

 

The street improvements and permanent right of way easements, sidewalk and utility easements, and temporary construction easements are depicted in Exhibit A attached hereto.

 

Under Preliminary Order (RES 25-1504), adopted October 1, 2025

 

WHEREAS, the Council of the City of Saint Paul has conducted a public hearing upon the above improvement and acquisition, due notice thereof having been given as prescribed by the City Charter; and

 

WHEREAS, the Council has heard all persons, objections and recommendations pertaining to said proposed improvement and acquisition and has fully considered the same; now, therefore, be it

 

RESOLVED, that the Council of the City of Saint Paul does hereby order that the above-described improvements be made, and the proper City officers are hereby directed and authorized to proceed with the improvements; and be it further

 

RESOLVED, that the Council hereby determines the real property rights required for these improvements to be permanent right-of-way easements, permanent sidewalk, drainage and utility easements, and temporary construction easements, as described above and depicted in Exhibit A, and the proper City officers and City Attorney are hereby authorized and directed to take all actions necessary to acquire said real property rights by direct purchase or eminent domain, including quick take; and be it finally

 

RESOLVED, that the Council hereby determines that the real property rights required for this improvement be as described above, and that the proper City officers submit a report to the City Council for the purpose of the Council’s making an award of damages, as needed, for the rights acquired on said real property.

 

Funding for the project costs and acquisition of property rights is budgeted in the 2025 Capital Improvement Budget.  Financing is provided through the One Cent Sales Tax and Special Assessments.
