Approving the application for approval of the amended/proposed license conditions 3, 6, 7, 8, 9, and 10 regarding the storage and parking of vehicles on the premises for Eagle Auto Body LLC d/b/a Eagle Auto Body LLC for the Auto Body Repair/Painting Shop (License ID #240000663) for the premises located at 786 Robert Street South.

WHEREAS, on March 4, 2025, a Notice of Violation and Request for Imposition of $500.00 Matrix Penalty (Notice”) was sent to the Applicant (Exhibit # 1) in which the Department of Safety and Inspections (“Department”) provided notice to the Applicant to pay the $500 matrix penalty fee, and move forward with adverse action supported by Saint Paul Legislative Code §310.03; and
WHEREAS, on March 7, 2025, the Applicant paid the $500.00 matrix penalty fee to the Department of Safety and Inspections; and
WHEREAS, Applicant has amended/proposed additional license conditions to the existing license conditions (Exhibit # 2); and
WHEREAS, the Council finds that the application is in order and there are no grounds to deny approval of the amended/proposed license conditions 3, 6, 7, 8, 9, and 10 regarding the storage and parking of vehicles on the premises now, therefore, be it,
RESOLVED, the license application for approval of the amended/proposed license conditions 3, 6, 7, 8, 9, and 10 regarding the storage and parking of vehicles on the premises, for the Auto Body Repair/Painting Shop license is hereby approved and issued to Eagle Auto Body LLC d/b/a Eagle Auto Body LLC (License ID #240000663) for the premises located at 786 Robert Street South, with the following licensing conditions:
Current License Conditions:
1. All customer and employee vehicles must be parked in accordance with the approved site/parking plan on file with the Department of Safety and Inspections (DSI). Appropriate measures shall be taken so that vehicles do not project into the public right-of-way (i.e., sidewalk).
2. There shall be no exterior storage of vehicle parts, tires, oil or any other similar materials associated with the business. Trash will be stored in a covered dumpster. Storage of vehicle fluids, batteries, etc. shall be in accordance with the Ramsey County Hazardous Waste regulations.
3. No vehicles under the control of the licensee can be parked and/or stored in the public right-of-way. This includes vehicles waiting for repairs and vehicles waiting to be picked up by the customer.
4. The storage of vehicles for the purpose of salvaging parts is expressly forbidden. Vehicle salvage is not permitted.
5. No repair of vehicles may occur on the exterior of the lot or in the public right-of-way (e.g., street, alley, sidewalk, boulevard, etc.). All repair work must occur within an enclosed building.
6. Auto repair is not permitted.
7. Vehicle sales is not permitted.
Amended/Proposed License Conditions 3, 6, 7, 8, 9, and 10:

7. Customer and/or employee vehicles may not be parked longer than ten (10) days on the premises. It shall be the responsibility of the licensee to ensure that any vehicles not claimed by its owner is removed from the lot as permitted by law.
8. Auto repair is not permitted.
9. Vehicle sales is not permitted.
10. Licensee must comply with all federal, state and local laws.
