Affirming the extension of Declaration of Local Emergency with an effective date of April 1, 2025 by Mayor Melvin Carter III.
Body
WHEREAS on March 29, 2024, the City of Saint Paul executed a contract with FCC Environmental Services, LLC (“FCC”) requiring FCC to provide citywide collection beginning on April 1, 2025; and
WHEREAS, on August 28, 2024, FCC purchased property at 560 Randolph Avenue in Saint Paul to store, fuel, and maintain trash collection vehicles when it began collecting trash citywide in Saint Paul on April 1, 2025; and
WHEREAS, on January 10, 2025, the City’s Zoning Administrator issued a Statement of Clarification determining that FCC’s proposed use of 560 Randolph Avenue as a truck dispatch and maintenance facility is similar in character and impact to a public works yard or maintenance facility, which is a permitted use in an I1 industrial zone; and
WHEREAS, on February 21, the Planning Commission unanimously concurred with the City Zoning Administrator’s determination; and
WHEREAS, a third-party appealed this determination, and on March 19, 2025, the Saint Paul City Council (“Council”) granted the third-party’s appeal, thereby overturning the Zoning Administrator’s Statement of Clarification, halting the site plan approval process, and impacting FCC’s ability to begin trash collection on April 1, 2025; and
WHEREAS, it is imperative to have continued trash collection beginning on April 1, 2025, so as to avoid a public health emergency and nuisance conditions related to uncollected trash; and
WHEREAS, Minnesota Statute Section 12.29 and Saint Paul Legislative Code Chapter 13.06(a) authorize the Mayor to declare a local emergency “when necessary to prevent or respond to emergencies;” and
WHEREAS, the Mayor of Saint Paul, Melvin Carter, has declared a local emergency effective Tuesday, April 1, 2025, due to the impending disruption to citywide trash collection; and
WHEREAS, the Mayor requests the City Council of City of Saint Paul to affirm and extend the April 1, 2025, Declaration of Emergency for the City of Saint Paul.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of City of Saint Paul affirms the Declaration of Local Emergency effective April 1, 2025, by the Mayor of Saint Paul, and
BE IT FURTHER RESOLVED, the City council finds that a local emergency does continue to exist in the City of Saint Paul regarding uninterrupted trash collection and extends the Declaration of Emergency for a period not to exceed 90 days from the date of, April 1, 2025, unless earlier rescinded by the Mayor.
