Authorizing the Public Library Agency to accept Minnesota Department of Education grant funds in the amount of $250,000 to support reconstruction of the Riverview Library and record a property declaration related thereto

WHEREAS, the City of Saint Paul (the “City”) through the Saint Paul Public Library Agency (“SPPL”) plans to reconstruct the Riverview Library located at 1 East George Street in the City (“Riverview Library”) as part of its Transforming Library’s Project (the “Riverview Reconstruction”); and
WHEREAS, the Riverview Reconstruction has a total cost of $9,558,000; and
WHEREAS, the City has title to the Riverview Library; and
WHEREAS, the State of Minnesota (the “State”) Department of Education (“MDE”) has awarded the City a $250,000 library construction grant (the “Grant”) funded by State general obligation bond proceeds to support the Riverview Reconstruction; and
WHEREAS, there are no matching funds required for the Grant; and
WHEREAS, the City wishes to accept the Grant and enter into a grant agreement with MDE (the “Grant Agreement”), which includes indemnification language in favor of the State, and requires the City to record a certain declaration against the Riverview Library property (the “Declaration”), declaring that said property is “bond financed property” for 125% of the useful life of the funded improvement, and a form of which is attached hereto as Exhibit A; and
WHEREAS, the City Council finds that the renovation of the Riverview Library has legitimate public purpose in providing high quality library and community services to City residents, and the expenditure of public funds, which includes the promise of indemnification and defense, will facilitate that public purpose; and
WHEREAS, the City Attorney’s Office has reviewed the Grant Agreement and Declaration and confirmed that City may record the Declaration against the Riverview Library; and now, therefore, be it
RESOLVED, the Library Board of the Saint Paul Public Library Agency hereby accepts the Grant, and authorizes the appropriate City and SPPL officials to enter into the Grant Agreement and execute and record the Declaration.
