Title
Amending Chapter 153 of the Legislative Code regarding Traffic Code - Various Offenses to add a prohibition against the use of engine braking by drivers on Interstate 94.

THE COUNCIL OF THE CITY OF SAINT PAUL DOES HEREBY ORDAIN:
Section 1.
That Legislative Code Chapter 153, Traffic Code - Various Offenses is hereby amended to read as follows:
Chapter 153. - Traffic Code-Various Offenses
Sec. 153.01. - Obedience to police officers.
(a) No person shall willfully fail or refuse to comply with any lawful order to direction of any peace officer invested by law with authority to direct, control or regulate traffic.
(b) Any police officer may, in case of necessity or emergency, or of congestion of traffic, make such special orders to pedestrians or to drivers of vehicles as in his or her judgment may be necessary to meet the emergency or to relieve the congestion, and it shall be the duty of every person to obey such directions or orders.
Sec. 153.02. - Rollerblading, rollerskating, skateboarding or ice skating.
No person shall ride or propel rollerblades, rollerskates, skateboards or ice skates upon a public street, highway or sidewalk within the City of Saint Paul in such a manner as endangers or is likely to endanger other persons or property, or in any manner whatsoever where prohibited by signs.
Sec. 153.03. - Riding on outside of vehicles.
No person shall, when riding, allow any part of the body to project beyond the limits of the vehicle, except when signaling with the arm, nor shall any person hang onto any vehicle.
Sec. 153.04. - Repairs on highways prohibited.
No person shall make any repairs to any vehicle on the highways of this city, except in an emergency.
Sec. 153.05. - Accident reports required.
(a) Report by driver. The driver of a vehicle involved in an accident resulting in injury to or death of any person or total property damage to an apparent extent of one thousand dollars ($1,000.00) or more shall, as soon as physically able after such accident, notify the police department and the department of public safety of the names and addresses of the persons involved in the accident, license numbers of the cars involved, the time and the place of the accident. In every case, such driver shall comply with all provisions of Minnesota Statutes, Section 169.09.
(b) Report of accident by driver or owner. Whenever the driver is physically incapable of making a written report of an accident as required in this chapter and such driver is not the owner of the vehicle, then the owner of the vehicle involved in such accident shall within ten (10) days after the incident make such report not made by the driver.
Sec. 153.06. - Speed; acceleration.
No person shall start or accelerate any motor vehicle with an unnecessary exhibition of speed on any public or private way within the city limits. Prima facie evidence of such unnecessary exhibition of speed shall be unreasonable squealing or screeching sounds emitted by the tires or the throwing of sand or gravel by the tires of said vehicle or both.
Sec. 153.07. - Speed limit in alleys.
No person shall drive a vehicle on any public alley in the City of Saint Paul at a speed greater than is reasonable and prudent under the circumstances, and in no event at a speed greater than ten (10) miles per hour.
Sec. 153.08. - Reserved.
Sec. 153.09. - Interference with traffic-control devices.
No person shall without lawful authority attempt to or in fact alter, deface, injure, knock down, remove or interfere with the operation of any official traffic-control device, including opticom devices, or any railroad sign or signal or any inscription, shield or insignia thereon, or any other part thereof.
Sec. 153.10. - Unauthorized signs and markings on curb or highway.
(a) No person shall place, maintain, or display upon or in view of any highway any unauthorized sign, signal, marking, or device which purports to be or is an imitation of or resembles an official traffic-control device or railroad sign or signal, or which attempts to direct the movement of traffic, or which hides from view or interferes with the effectiveness of any official traffic-control device or any railroad sign or signal, and no person shall place or maintain, nor shall any public authority permit, upon any highway any traffic sign or signal bearing thereon any commercial advertising.
(b) Every such prohibited sign, signal, or marking is hereby declared to be a public nuisance, and the City is hereby empowered to remove the same, or cause it to be removed, without notice.
Sec. 153.11. - Motor buses, stopping.
Drivers of motor buses, when stopping to pick up or discharge passengers, shall, wherever a clear space of eighty (80) feet or more of clear curb is available, place the right-hand wheels of the bus parallel with and within twelve (12) inches of the right-hand curb.
Sec. 153.12. - Backing.
No vehicle shall be backed upon the highway/street/roadway for a distance greater than twenty-five (25) feet, but in no case shall a vehicle be backed from one highway into another unless the driver thereof is directed to do so by police or fire department officers.
Sec. 153.13 - Engine Braking Prohibited
Pursuant to the authorization provided to the city in Chapter 75, Article II, Section 53, 2015 Minnesota Session Laws, it shall be unlawful for the driver of any motor vehicle to use an engine brake on any vehicle while traveling along Legislative Route No. 392, also known as marked Interstate Highway 94, between Johnson Parkway and marked Trunk Highway 52, in the City of St. Paul. For purposes of this section, “engine brake” means any device that uses the engine and transmission to impede the forward motion of the motor vehicle by compression of the engine.
Section 2.
This ordinance shall be in full force and effect thirty (30) days from and after its passage, approval and publication.
