Approving Liquor On Sale - 291 or More Seats, Liquor On Sale-Sunday, Liquor On Sale - 2 AM Closing, Liquor Outdoor Service Area (Sidewalk), Liquor Outdoor Service Area (Patio), and Entertainment (B) licenses with conditions to Lowry Kitchen & Bar, LLC, d/b/a Bookmakers (License ID #20140003650) at 345 Wabasha Street North.

WHEREAS, Lowry Kitchen & Bar, LLC d/b/a Bookmakers (License ID #20140003650) applied for a Liquor On Sale - 291 or More Seats; Liquor On Sale-Sunday; Liquor On Sale - 2 AM Closing; Liquor Outdoor Service Area (Sidewalk); Liquor Outdoor Service Area (Patio); and an Entertainment (B) license for the premises located at 345 Wabasha Street North in Saint Paul; and
WHEREAS, the premises is located downtown so a petition is not required; and
WHEREAS, the Department of Safety and Inspections received no objections to the issuance of the licenses; and
WHEREAS, the Council finds that the application is in order and there are no grounds for denial of a Liquor On Sale - 291 or More Seats; Liquor On Sale-Sunday; Liquor On Sale - 2 AM Closing; Liquor Outdoor Service Area (Sidewalk); Liquor Outdoor Service Area (Patio); and an Entertainment (B) license; now, therefore, be it,
RESOLVED, a Liquor On Sale - 291 or More Seats; Liquor On Sale-Sunday; Liquor On Sale - 2 AM Closing; Liquor Outdoor Service Area (Sidewalk); Liquor Outdoor Service Area (Patio); and an Entertainment (B) license are hereby granted to Lowry Kitchen & Bar, LLC d/b/a Bookmakers (License ID #20140003650) for the premises located at 345 Wabasha Street North in Saint Paul with the following conditions:
1. The licensee shall be responsible for monitoring to ensure that patron consumption of liquor remains in the designated liquor service areas. The licensee is also responsible for maintaining the liquor service areas "compact and contiguous" between the first floor restaurant area and the 11th floor. A pathway from the main floor service area shall be created directing patrons to elevator "car #2". The pathway shall be delineated with carpet or similar contrasting floor treatment, designating it as part of the liquor service area. This elevator car must be signed designating it exclusively for the purpose of taking the Bookmaker patrons to the 11th floor dining/liquor service area and must be programmed to transport patrons to and from the 11th floor without stopping on any other floors.
2. Licensee agrees to limit the number of seats placed on the public sidewalk to that shown on the approved sidewalk seating plan on file with the Department of Safety and Inspections (DSI).
3. Each year prior to the placement of table(s) and/or chair(s) in the public right-of-way (i.e., sidewalk), the licensee agrees to obtain a new Obstruction Permit from the Department of Public Works. Licensee agrees to maintain the sidewalk café in accordance with the conditions placed on an approved Obstruction Permit, acknowledges that an Obstruction Permit is effective on April 1 and expires on October 31 of each year, that table(s) and/or chair(s) may not be placed in the public right-of-way before or after the effective/expiration dates, and that a failure to comply with this condition will result in adverse action being taken against all of their licenses.
4. Licensee agrees to take appropriate action(s) to ensure that the sale, display, and/or consumption of alcoholic beverages is contained within the defined area as per the approved sidewalk seating plan on file with DSI.
