WHEREAS, on June 17, 2024, Khue’s Kitchen LLC d/b/a Khue’s Kitchen LLC (License ID #20240001056) applied for a change of ownership to the Liquor on Sale - 100 Seats or less, Liquor on Sale - Sunday, and Liquor Outdoor Service Area (Patio) license for the premises at 799 University Avenue West, in Saint Paul; and
WHEREAS, the license application notification was sent out by the Department of Safety and Inspections (DSI) on July 19, 2024, with a response date of August 3, 2024; and
WHEREAS, in response to the notification no objections or comments were received; and
WHEREAS, the Council finds that the application is in order and there are no grounds to deny approval of the license; now, therefore, be it,
RESOLVED, the change of ownership for the Liquor on Sale - 100 Seats or less, Liquor on Sale - Sunday, and Liquor Outdoor Service Area (Patio) license is hereby approved and issued to Khue’s Kitchen LLC d/b/a Khue’s Kitchen LLC (License ID #20240001056) for the premises located at 799 University Avenue West in Saint Paul with the following existing licensing conditions:
1. Licensee agrees to operate the establishment in compliance with Section 409.02 of the City of Saint Paul Legislative Code as a “Restaurant”.
2. Licensee agrees to close the establishment at 12:00 a.m. midnight. All patron/customers shall vacate the premises by 12:30 a.m. each day of the week as per Section 409.02 of the City of Saint Paul Legislative Code.
3. The sale/service/delivery of food, wine, and/or beer for the patio seating area is not permitted to take place in the public right-of-way (i.e., sidewalk). All sale/service/delivery shall only take place over private property at 799 University Ave W.
4. The service/delivery of food and/or beverage items shall only be performed by employees/staff of the establishment. Customer/patrons cannot carry items to or from the patio area.
