Approving the temporary renewal pending adverse action against the Liquor On-Sale 101-180 seats, Liquor On-Sale Sunday, and Entertainment (C) (“Licenses”) held by LL Entertainment Services Inc., d/b/a The Lamplighter Lounge, for the premises located at 160 Larpenteur Avenue West under License ID #: 200200000805, for the Licenses held by LL Entertainment Services Inc., d/b/a Lamplighter Lounge (“Licensee”).

WHEREAS, the LL Entertainment Services Inc. (“Licensee”), d/b/a Lamplighter Lounge (License ID #20020000805) holds the following Licenses Liquor On-Sale 101-180 seats, Liquor On-Sale Sunday, Liquor On-Sale - 2 AM Closing and Entertainment (C) (“Licenses”) for the premises located at 160 Larpenteur Avenue (“Licensed Premises”) in Saint Paul; and
WHEREAS, under Saint Paul Legislative Code Section 310.08 all licenses or permits are valid for a period of one (1) year from the date of issuance; and
WHEREAS, DSI identified the following serious incidents:
May 26, 2018 Assault in parking lot
June 8, 2018 Assault in parking lot
September 11, 2018 Shooting in lot
September 21, 2018 Shots fired
July 9, 2019 Patrons shot in lot
August 26, 2020 Former employees fighting in bar
on and near the Licensed Premises by individuals reported to be either former employees or patrons, and, therefore, the Department of Safety and Inspections recommended that conditions be added to the Licenses held by Licensee; and
WHEREAS, on June 13, 2020, Nia Black was shot and killed in the parking lot of the Licensed Premises; and
WHEREAS, on March 24, 2021, under St. Paul Leg. Code § 310.04 (d)(2), the Council held a public hearing regarding renewal of the licenses where many community members testified about significant safety concerns surrounding the Licensed Premises; and
WHEREAS, based on testimony at the March 24, 2021 public hearing, there may be other nearby incidents connected to the Licensed Premises that are not currently part of the record and were not considered when the Department of Safety and Inspections made its recommendation; and
WHEREAS, the Council believes that the imposition of the proposed license conditions will not sufficiently improve safety and help ensure the well-being of staff, patrons and the surrounding community; and
WHEREAS, the above-stated licenses expire on April 1, 2021; and
WHEREAS, if the licenses are not renewed, licensee will be unable to operate pending any adverse action; and
WHEREAS, Minn. Stat. § 340A.415 states that “no suspension or revocation takes effect until the license or permit holder has been given an opportunity for a hearing under sections 14.57 to 14.69 of the Administrative Procedure Act”; and
WHEREAS, the Council would like to refer this matter to the City Attorney’s Office for a full review of intendents connected to the Licensed Premises and adverse action up to and including license revocation; now, therefore, be it,
RESOLVED, that the Liquor On-Sale 101-180 seats, Liquor On-Sale Sunday, and Entertainment (C) licenses are hereby renewed temporarily pending adverse action for LL Entertainment Services Inc., d/b/a Lamplighter Lounge (License ID #20020000805) for the premises located at 160 Larpenteur Avenue in Saint Paul; and be it further
RESOLVED, that the matter is referred to the City Attorney’s Office for further investigation and appropriate adverse action.
