Pertaining to an Agreement for Sale and Purchase of Real Property with David G. and Christine M. Lehto for the purchase of a residential property addressed as 1772 Sylvan Street North in the city of Maplewood.
Body
WHEREAS, the Board of Water Commissioners desires to purchase the residential property addressed as 1772 Sylvan Street North in the city of Maplewood to provide greater setback from private property in order to enhance perimeter security at its McCarrons Water Treatment Plant property; and
WHEREAS, the property owners contacted the Board and expressed a desire to sell the property to the Board by the end of the summer, if possible; and
WHEREAS, at its June 14, 2016 meeting, the Board authorized staff to negotiate a purchase price with property owners David W. and Christine A. Lehto not to exceed the 2016 County Valuation of $149,900, and to use reasonable discretion to address all other terms and conditions necessary to obtain the owners’ approval of a purchase agreement; and
WHEREAS, staff negotiated a purchase price in the amount of $149,900.00, with all closing costs to be paid by the Board; and
WHEREAS, the property owners have a right to request or to waive relocation benefits pursuant to Minn. Stat. Sec. 117.52 and 117.521, and staff is hereby authorized to negotiate said benefits within the parameters of the statute and to report any dollar amounts to the Board at a later time; and
WHEREAS, City of Saint Paul Real Estate Division has drafted an Agreement for Sale and Purchase of Real Property, which reflects said purchase price and closing costs provision, and the assistant city attorney has approved said Agreement as to form; now, therefore, be it
RESOLVED, that the Agreement for Sale and Purchase of Real Property between the Board of Water Commissioners and David W. and Christine A. Lehto for purchase of real property addressed as 1772 Sylvan Street North in the city of Maplewood for the amount of $149,900.00 is hereby approved and that the proper officers are hereby authorized and directed to execute said Agreement on behalf of the Board; and, be it
FURTHER RESOLVED, that the General Manager of Saint Paul Regional Water Services or his designee is hereby authorized to execute any and all closing documents on behalf of the Board.
