Approving the partial release of the City's sewer utility easement rights referenced in Ramsey County, Document Number 238392.

WHEREAS, in 1946, as part of an improvement project affecting the properties in the plat Lane's Edgcumbe Hills, Saint Paul, Minnesota in Ramsey County, the City of Saint Paul ("City") received an easement agreement for sewer utility and right-of-entry purposes throughout the aforementioned plat. The agreement dated July 27,1946 was recorded in Ramsey County property records as Document Number 238392 on December 6,1946, a copy of which is attached hereto; and
WHEREAS, a portion of the easement encumbers the south 100 feet of the east 263.4 feet of Lot 79, Lanes Edgcumbe Hills, also known by Parcel ID #222823220080 (the "Property") and is owned by Trellis Treehouse Acquisition LLC ("Owner"); and
WHEREAS, on behalf of the Owner, Andy Hughes of Mahoney Development Services, has requested the release of the City's easement rights encumbering the Property; now, therefore, be it
RESOLVED, that with the Certificate of Intended Non-Use, filed voluntarily on behalf of the City's Department of Public Works, the City, for itself and on behalf of said department, hereby waives, releases and terminates its easement rights encumbering the Property as referenced in Ramsey County Document Number 238392, recorded December 6, 1946; and be it further
RESOLVED, that upon passage of this resolution and the City's receipt from the Owner of a $300.00 administrative processing fee, the proper City officials are hereby authorized and directed to record a copy of this resolution in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the Office of Financial Services Real Estate Section shall maintain on file a copy of the Certificate of Intended Non-Use referenced in this resolution; and be it finally
RESOLVED, that all other terms and conditions of Ramsey County Document Number 238392 shall remain in full force and effect and be fully incorporated into this resolution.
