Approving adverse action against all licenses held by Mars Enterprizes, LLC, d/b/a Half Time Rec at 1013 Front Avenue. (Public hearing held April 16)

WHEREAS, all licenses held by Mars Enterprizes, LLC d/b/a Half Time Rec (License ID #20090003003) for the premises located at 1013 Front Avenue in Saint Paul were the subject of a Notice of Violation dated February 20, 2014, stating that the licensee failed to provide a copy of video surveillance for the evening of January 15, 2014 from 11:30 p.m. to closing, which was requested by the Department of Safety and Inspections in violation of license condition #9 [sic] (10); and
WHEREAS, per Saint Paul Legislative Code ยง 310.05 (m) (1), the licensing office recommended an $500.00 matrix penalty and an update to license condition #9 [sic] (10) to reflect the current language; and
WHEREAS, licensee did respond to the Notice of Violation to contest the penalty and update to license condition #9 [sic] (10) and requested a public hearing which was held on April 16, 2014; now therefore be it
RESOLVED, Mars Enterprizes, LLC d/b/a Half Time Rec is hereby ordered to pay a matrix penalty of $500.00 for failure to submit a copy of video surveillance for the evening of January 15, 2014 from 11:30 p.m. to closing, which was requested by the Department of Safety and Inspections in violation of license condition #9 [sic] (10). The $500.00 penalty will be stayed for a period of twelve (12) months given no same or similar violations. Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
FURTHER RESOLVED, the following language will replace the licensee's current language for license condition #9 [sic] (10):
9.10. Licensee will The license holder shall install and maintain a video surveillance cameras system in accordance with Saint Paul Police Department (SPPD) recommendations inside and outside the establishment. Cameras must be recording during all hours of operation. Tapes shall be maintained for 30 days and be made available to SPPD and inspection staff immediately upon request. District 6 will work with the licensee to provide partial funding for the video system. Licensee must have the equipment installed by August 1, 2010. The video recordings shall be kept by the license holder for at least thirty (30) days and shall be available for viewing by the Saint Paul Police Dept. immediately upon request. In addition, if the Saint Paul Police Dept. responds to a call at the licensed premises, and due to the serious nature of the crime, requests that a copy of the surveillance footage be immediately provided, the license holder shall have technology available to make the copy at the time of the request and shall have it for the Police without delay. In other cases, if the Saint Paul Police Dept. or the Dept. of Safety and Inspections requests copies of the surveillance tapes, licensee shall have a 48-hour period in which to provide such copies. A camera and lighting placement plan shall be submitted to DSI to review and approve.
