Title

Approving a Partial Waiver of the Sustainable Building Ordinance for Afton View Apartments, 371 and 373 Winthrop Street South, 2180 and 2178 Londin Lane and 365 Winthrop Street South, District 1, Ward 7

 

Body

WHEREAS, in January 2018, the City Council of the City of Saint Paul adopted the Sustainable Building Ordinance (Ord 17-60, Chapter 81) for (a) New construction or the major renovation of facilities owned or operated by the City of Saint Paul or the HRA, (b) New construction or the major renovation of any facilities of which the city or HRA are, or will become, the sole tenant, and (c) New construction or major renovation of any facilities within the City of Saint Paul receiving more than two hundred thousand dollars ($200,000) of city funding; and

WHEREAS, the Ordinance requires that such buildings be certified under one of the eligible green building standards, and comply with each of the requirements found in the Saint Paul Overlay; and

WHEREAS, the Saint Paul Overlay includes specific requirements related to energy use, greenhouse gas emissions, potable water use, construction waste, indoor environmental quality, and stormwater management; and

 

WHEREAS, Afton View Apartments is an approximately 286-unit multifamily housing development consisting of two 3-story buildings located at 371 and 373 Winthrop St. S., 2180 and 2178 Londin Lane and 365 Winthrop St. S. in the City (the “Project”);

 

WHEREAS, the Project is required to comply with the Sustainable Building Ordinance and Saint Paul Overlay; and

 

WHEREAS, the Center for Sustainable Building Research (CSBR) at the University of Minnesota developed and manages the SB 2030 energy standard for the State of Minnesota, and

 

WHEREAS, the Saint Paul Overlay requires compliance with the SB 2030 energy standard; and

 

WHEREAS, CSBR staff have determined that applying the SB 2030 energy standard to the Afton View Apartments renovation project would result in unintended consequences that would negatively impact the residents; and

 

WHEREAS, CSBR staff developed an alternative prescriptive path to SB 2030 compliance, which includes the installation of highly efficient equipment, including the following:

•                     Central boiler - 95% AHRI-certified combustion efficiency

•                     Window AC units - ENERGY STAR certified, 15 CEER or better

•                     Ranges - ENERGY STAR certified

•                     Range hoods - ENERGY STAR certified

•                     Dishwashers - ENERGY STAR certified

•                     Combined washer/dryer units for ADA apartments - ENERGY STAR certified

•                     Refrigerators/freezers - ENERGY STAR certified

•                     Shower heads - 1.75 gallons per minute

•                     Kitchen faucets - 1.75 gallons per minute

•                     Bathroom faucets - 1.2 gallons per minute

•                     Toilet - 1.28 gallons per flush; and

 

 

WHEREAS, pursuant to the terms of Administrative Code Section 81.05, the requirements of Chapter 81 of the Saint Paul Administrative Code may be waived, in whole or in part, by the HRA Board of Commissioners in the event that the expenditure of city funds is approved by the HRA board; now, therefore,

 

BE IT RESOLVED, that the Board of Commissioners of the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota, hereby waives the portion of the requirement in Chapter 81 of the Saint Paul Administrative Code requiring the Afton View Apartments project to comply with the SB 2030 energy standard; and

 

BE IT FURTHER RESOLVED, that the Afton View Apartments project must fully comply with the other efficiency measures described in this resolution; and

 

BE IT FINALLY RESOLVED, that if the Afton View Apartments’ scope of work changes, and other items such as windows, washing machines, clothes dryers, furnaces, individual water heaters, etc., are to be installed, Tareen Development Partners, TDP St. Paul Housing, LP, or related entity must inform CSBR staff of the changes and follow the instructions provided by CSBR.
