Approving the application with conditions, per the Legislative Hearing Officer, for the application submitted by Fernando & Sons Auto Repair Inc, d/b/a same (License ID#20240001116), for an Auto Repair Garage license located at 670 Snelling Avenue N.

 

Body

WHEREAS, Fernando & Sons Auto Repair Inc, d/b/a same (License ID#20240001116), located at 670 Snelling Avenue N, has applied for an Auto Repair Garage Class N license; and

 

WHEREAS, the applicant notified the Hamline Midway Coalition Community Council prior to their application; and

 

WHEREAS, a notification regarding the license application was sent from the Department of Safety and Inspections to the affected neighborhood for the period of July 15, 2024 to July 30, 2024; and

 

WHEREAS, during the notification period, concerns were received which triggered the hearing and a hearing was held on August 8, 2024; and

 

WHEREAS, the concerns were related to parking in the alley and hours of operation; and

 

WHEREAS, in response to the concerns raised, the licensee has agreed to work with the city to comply with the necessary requirements to minimize nuisance activities that would disturb the surrounding residential neighborhood; and

 

WHEREAS, after conducting the hearing and considering the testimonies and evidence, the Legislative Hearing Officer recommends that the application for Fernando & Sons Auto Repair Inc, d/b/a same (License ID#20240001116), located at 670 Snelling Avenue N, be approved with the following conditions:

 

1.  All customer and employee vehicles must be parked in accordance with the approved site plan on file with the Department of Safety and Inspections (DSI) dated 05/29/2018.  A maximum of eight (8) vehicles may be parked on the property at any time.

2.  The parking lot shall be striped and maintained in accordance with the approved site plan on file with DSI dated 05/29/2018.  This includes striping of individual parking spaces (including one handicap parking space with striping/signage), wheel stops, etc.

3.  There shall be no exterior storage of vehicle parts, tires, oil or any other similar materials associated with the business.  Trash will be stored in a covered dumpster or within the building as per the approved site plan.  Storage of vehicle fluids, batteries, etc. shall be in accordance with the Ramsey County Hazardous Waste regulations.

4.  No vehicles under the control of the licensee can be parked and or stored in the public right-of-way (e.g., street, alley, sidewalk, boulevard, etc.). This includes vehicles waiting for repair or repaired vehicles waiting to be picked up by the customer.  

5.  The storage of vehicles for the purpose of salvaging parts is expressly forbidden.  Vehicle salvage is not permitted.

6.  All vehicles parked outdoors must appear to be completely assembled with no major body parts missing.

7.  No repair of vehicles may occur on the exterior of the lot or in the public right-of-way (e.g., street, alley, sidewalk, boulevard, etc.).  All repair work must occur within an enclosed building.

8.  Vehicle sales is not permitted.

9.  Auto body repair and/or painting of vehicles is prohibited.

10.  Customer vehicles may not be parked longer than ten (10) days on the premises.  It shall be the responsibility of the licensee to ensure that any vehicle not claimed by its owner is removed from the lot as permitted by law.

11.  Provide maneuvering space on the property to allow vehicles entering and exiting the site to proceed forward.  Backing from the street or on to the street is prohibited.

12.  Licensee must comply with all federal, state and local laws.

 

NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Saint Paul hereby approves this license application with the aforementioned agreed-upon conditions and finds that the license conditions are reasonable, and the application is in order and there are no grounds to deny the approval of the licenses.

 

The conditions affidavit was signed and submitted on August 8, 2024.
