Title

Considering the appeal of a decision by the Board of Zoning Appeals denying an appeal of a zoning approval for a building permit based on alleged improper application of the standards in Section 61.402(c)(4) and (5) of the Zoning Code.

Zoning File: # DSIAPP-000795-2026 (Administrative Appeal File # DSIAPP-000702-2026)

File Name: 2094 Goodrich Avenue

Appellant: Joe Galante

Applicant: Joe Galante

Address: 2096 Goodrich Avenue

Purpose: An appeal to the City Council of a decision by the Board of Zoning Appeals (BZA) that denied an appeal of a zoning approval issued for a building permit. The appellant alleges that the review did not properly apply the standards in Section 61.402(c)(4) and (5) of the Zoning Code. Specifically, the appeal raises concerns that the approved plans did not adequately ensure:

a) Protection of adjacent properties through sufficient controls over drainage, noise, light, and views; and

b) Reasonable site layout, including whether the arrangement of buildings and uses may result in unreasonable adverse impacts on immediate neighbors.

Staff Recommendation: Denial

District Council Recommendation: Macalester Groveland Community Council is in favor of the appeal

Board of Zoning Appeals Decision: The Board of Zoning Appeals denied the request via a 4-0 vote.

Support: 4 people spoke, 52 letter received
