WHEREAS, in the matter of Kristin Becker to a Correction Order at 775 Edmund Avenue, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant;

 

WHEREAS, based on the findings of the September 15, 2026 Legislative Hearing, the Legislative Hearing Officer recommends recommended that the City Council grant to October 9, 2026 for compliance (via approved site plan + variance) or reduction of fence height to 7 feet. Staff to delete pending Excessive Consumption Inspection fee; and

 

WHEREAS, the owner made application for a fence permit September 29, 2026 and the permit was denied October 6, 2026, the Legislative Hearing Officer amends the recommendation to grant to October 23, 2026 to 1) file an appeal with the Legislative Hearing Office of the Building Official's decision; or 2) come into compliance with May 20, 2026 Correction order;

 

WHEREAS, If an appeal of the fence permit denial is granted, no further action is required and if the appeal is denied, a new date for compliance will be determined at that time, Now, Therefore, Be It

 

RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
