Approving adverse action against all licenses held by The Depot Express, LLC, d/b/a Mojo Monkey, 1169 Seventh Street West.

WHEREAS, adverse action was taken against all licenses held by The Depot Express, LLC d/b/a Mojo Monkey (License ID #20110001314) for the premises located at 1169-7th Street West in Saint Paul by Notice of Violation dated March 27, 2012, alleging the licensee was cited for one (1) Critical-Major Environmental Health Code violation during a re-inspection of the licensed premises on February 21, 2012; and
WHEREAS, per Saint Paul Legislative Code ยง 310.05 (m) (9), the licensing office recommended a $175.00 matrix penalty and suspension of all licenses until the violation was corrected; and
WHEREAS, the licensee did respond to the Notice of Violation to contact the Environmental Health Inspector to schedule a re-inspection; and
WHEREAS, the inspector conducted a re-inspection on April 5, 2012 and found that the licensee was now in compliance; and
WHEREAS, although the licensee was now in compliance, they failed to pay the $175.00 matrix penalty for the February 21, 2012 violation; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $175.00 matrix penalty by April 6, 2012, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that The Depot Express, LLC d/b/a Mojo Monkey is hereby ordered to pay a matrix penalty of $175.00 for one (1) Critical-Major Environmental Health Code violation cited by the inspector during the re-inspection of the licensed premises on February 21, 2012. Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
