WHEREAS, the Tobacco Shop license (“License”) held by Mohammed Ibrahim & Ali Abdullane d/b/a Annapolis Super USA #002 (License ID# 20160003307) at 1333 Thomas Avenue in Saint Paul (“Licensed Premises”) was the subject of a Notice of Violation and Request for Revocation of License, herein incorporated as Exhibit 1 (“Notice”) sent February 27, 2023; and
WHEREAS, the Notice alleged, that during a complaint-based inspection on February 2, 2023, a DSI inspector observed and documented with a report and photographs prohibited flavored tobacco products found by the Minnesota Department of Revenue (MDR) on the license premises in violation of Saint Paul Legislative Code section 324.07(j); and
WHEREAS, under the penalty matrix contained in Saint Paul Legislative Code section 324.10(b)(2), the presumptive penalty for a second violation of section 324.07(j) is revocation of the license; and
WHEREAS, the Notice stated that if the Licensee failed to request a public or administrative hearing by February 22, 2023, that the matter would be placed on the next available consent agenda to impose the recommended penalty; and
WHEREAS, On March 10, 2023, the licensee’s responded to the Notice of Violation and Request for Revocation of License by letter requesting a public hearing before City Council; now, therefore, be it
RESOLVED, that the Tobacco Shop license held by Mohammed Ibrahim & Ali Abdullane d/b/a Annapolis Super USA #002 (License ID# 20160003307), for the premises located at 1333 Thomas Avenue is hereby revoked for selling prohibited flavored tobacco products on the licensed premises as documented during a complaint-based inspection on February 2, 2023.
