WHEREAS, Lund Food Holdings, Inc. d/b/a Lunds & Byerlys (the “Applicant”), applied for a Liquor On Sale-100 seats or less; a Liquor On Sale-Sunday; a Liquor Outdoor Service Area (Patio) and an Entertainment (A) license for the premises located at 2170 Ford Parkway in Saint Paul; and
WHEREAS, the Department of Safety and Inspections (the “Department”) recommended that a condition be imposed on the licenses applied for by the Applicant; and
WHEREAS, under section 310.04 (c) of the Saint Paul Legislative Code, the Department may impose conditions upon a license only when there is a reasonable basis, regardless of whether the license applicant consents to the imposition of such conditions; and
WHEREAS, the Applicant agreed to have the recommended condition imposed on the license; and
WHEREAS, on August 24, 2022, the Council approved the license with the agreed-to condition; (RES 22-1317); and
WHEREAS, the Licensee submitted a request to remove the License Condition that requires Mezz staff to deliver all food to tables; and
WHEREAS, on March 17, 2023, the Department sent out the required License Application Notification regarding the request to remove the license condition; and
WHEREAS, in response to the March 17, 2023, notification the Department of Safety and Inspections received no objections to the removal of the license condition; now, therefore, be it
RESOLVED, that the Council does hereby remove the existing license condition requiring Mezz staff to deliver food to the tables from the Liquor On Sale-100 seats or less; Liquor On Sale-Sunday; Liquor Outdoor Service Area (Patio) and Entertainment (A) licenses held by Lund...
