Marcia Moermond, Legislative Hearing Officer: This is an assessment for a summary
abatement order. A photo on screen in front of you shows the order and a photo of the
red couch in question. The order was to dispose of the couch and pallets from the rear
of the property. Upon reinspection, the couch was gone but the pallets remained. The
pallets were still there when the contractor came to abate the nuisance, and they were
removed. Photos on screen show what the property looked like before and after the
abatement. The cost was $440 total. The appellant is disputing how the pallets were
handled and whether they remained in violation.
Tom Fischer: I ask that this assessment be deleted or reduced. The contractor
removed objects that weren't cited and were sitting on the neighboring parcel. The City
also acted long after I had complied and did not get a fresh notice as required by law.
In the photos, there was a grey couch on the neighboring lawn that was taken away.
That was not included at all in the original orders. The order gave me 5 days for the red
couch and pallets. I met that deadline for the couch and arranged removal for the
pallets within 5 days. They were all removed from the property. There were two stacks
of pallets. The photos on screen show the grey couch being taken away. That garage
is our neighbor's and it's not our property. The blue pallets on screen were part of the
much larger stack for an event we had in our backyard. The big stack was removed
and this smaller stack was intentionally kept to use as a parking pad for cars to back
up. After we removed the larger stack, we never received notice from the City that the
smaller stack of pallets was not in compliance. I support the City's cleanup program,
but I acted quickly, stayed in communication, and was billed for an item not on my
property that was never cited. If this is just for the pallet stack, that should only be a
$40 assessment.
Councilmember Privratsky moved to close the public hearing. Approved 7-0.
Privratsky: I need more time to talk with Moermond about this and move to lay over for
one week.
