lot of dirt and we no longer would consider that a legal parking surface. The vehicles
have tabs from 2010, 2011, and 2024 and all appear to be inoperable. The trailer does
not have license plates. The Department of Safety and Inspections (DSI) issued the
abatement order on February 18, 2025 with a deadline of February 24, 2025. I
recommend that you deny the appeal and grant an extension to April 14, 2025, for
compliance. We talked a lot in Legislative Hearing about how compliance could be
achieved. One way would be to remove the vehicles from the spot where parking is not
allowed. The other method would be to turn the currently unapproved surface into an
approved surface. This would involve getting approval from DSI Zoning staff.
Shein Yang: I am the appellant, but I will be having a friend speaking on behalf of me
for the rest of my time.
Kong Vang: The owner never received a correction letter from the City. If something is
wrong, they need to tell the owner what needs to be corrected. The owner should have
been told it was not allowed to be a parking area. The owner has been there 30 years
and never had this problem.
Shein Yang: There is grass and gravel. It's not just dirt.
Kong Vang: I want the Council to make the City write a letter saying what we need to
do and give us more time.
Councilmember Yang moved to close the public hearing.
Councilmember Yang: I just want to make sure I'm looking at the right spot for the
trailer, which looks like a boat.
Moermond: The photos say "unknown boat/trailer." On screen is a photo showing the
trailer inside the fence on the backyard grass.
Councilmember Yang: Those other vehicles on screen are illegally parked as well,
correct?
Moermond: Yes.
Councilmember Yang: There is no cost being imposed right now, correct? The order is
to either move the vehicles or go through the process to make the space approved?
Moermond: This is a vehicle nuisance abatement order. This informed the owner that
vehicles meeting the City's definition of abandoned vehicles are parked on an
unapproved surface. It's saying that the vehicles need to be removed or else the City
will remove them and charge the owner for that. If they want to avoid that, they can
correct the surface, get the correct licensing and tabs, and make the vehicles
operable. The strict issue here is the nuisance itself. The path forward is something
that the owner would carve out according to their interests and financing. We don't tell
them how many parking spaces to put in. We outline the violations.

Moermond: Yes.
Councilmember Yang: The testifier said the owner was never notified. When was the
notice received, if it was received?
Moermond: On screen is the February 18 order from DSI. The notice was brought in
when the appeal was filed and it is attached to the appeal.
