Marcia Moermond, Legislative Hearing Officer: This is an appeal of a vehicle  
abatement order on 4 vehicles. There are 3 cars and a trailer. On screen in front of you  
are street photos and aerial photos showing the vehicles not parked on an approved  
surface. There is gravel in some spots, but the gravel has degraded to where there is a  
lot of dirt and we no longer would consider that a legal parking surface. The vehicles  
have tabs from 2010, 2011, and 2024 and all appear to be inoperable. The trailer does  
not have license plates. The Department of Safety and Inspections (DSI) issued the  
abatement order on February 18, 2025 with a deadline of February 24, 2025. I  
recommend that you deny the appeal and grant an extension to April 14, 2025, for  
compliance. We talked a lot in Legislative Hearing about how compliance could be  
achieved. One way would be to remove the vehicles from the spot where parking is not  
allowed. The other method would be to turn the currently unapproved surface into an  
approved surface. This would involve getting approval from DSI Zoning staff.  
Shein Yang: I am the appellant, but I will be having a friend speaking on behalf of me  
for the rest of my time.  
Kong Vang: The owner never received a correction letter from the City. If something is  
wrong, they need to tell the owner what needs to be corrected. The owner should have  
been told it was not allowed to be a parking area. The owner has been there 30 years  
and never had this problem.  
Shein Yang: There is grass and gravel. It's not just dirt.  
Kong Vang: I want the Council to make the City write a letter saying what we need to  
do and give us more time.

Councilmember Yang: I just want to make sure I'm looking at the right spot for the  
trailer, which looks like a boat.  
Moermond: The photos say "unknown boat/trailer." On screen is a photo showing the  
trailer inside the fence on the backyard grass.  
Councilmember Yang: Those other vehicles on screen are illegally parked as well,  
correct?  
Moermond: Yes.  
Councilmember Yang: There is no cost being imposed right now, correct? The order is  
to either move the vehicles or go through the process to make the space approved?  
Moermond: This is a vehicle nuisance abatement order. This informed the owner that  
vehicles meeting the City's definition of abandoned vehicles are parked on an  
unapproved surface. It's saying that the vehicles need to be removed or else the City  
will remove them and charge the owner for that. If they want to avoid that, they can  
correct the surface, get the correct licensing and tabs, and make the vehicles  
operable. The strict issue here is the nuisance itself. The path forward is something  
that the owner would carve out according to their interests and financing. We don't tell  
them how many parking spaces to put in. We outline the violations.  
Councilmember Yang: Was that explained to the property owner?  
Moermond: Yes.  
Councilmember Yang: The testifier said the owner was never notified. When was the  
notice received, if it was received?  
Moermond: On screen is the February 18 order from DSI. The notice was brought in  
when the appeal was filed and it is attached to the appeal.

Marcia Moermond, Legislative Hearing Officer: This is an appealed special tax  
assessment for a vacant building registration covering May 2, 2024 through May 2,  
2025. We are 10.5 months into the period covered by this fee. You heard the appeal of  
the registration last year and denied it. The Department of Safety and Inspections  
(DSI) issued a 3-month waiver that comes automatically after a fire. In Legislative  
Hearing, the owner stated that insurance won't cover the vacant building fee, and that  
she doesn't believe the building should be in the vacant building program. A building  
permit was pulled in mid-December and has had a rough-in inspection. An electrical  
permit was pulled in January and has had a rough-in inspection. In late January the  
permit was pulled for plumbing. Progress is being made and I think it's likely that there  
will not be a fee to renew the vacant building registration in May.  
Councilmember Yang: Is it common for insurance to not cover this fee?  
Moermond: It's a mixed bag. It depends on the insurance company and the plan the  
owner has.  
Javonna McCoy-Barber: Our house will be completed next week. That's when we will  
move back in and have our final inspections. The vacant building program is for people  
who aren't planning on doing anything with their property, but I've done everything I've  
needed to do. The City hasn't provided me any services. Trash is still out there. Grass  
hasn't been cut. They don't shovel the snow. People have broken in. The City has not  
provided anything. My insurance won't cover this and I cannot afford it.  
Yang moved to close the public hearing.  
Yang: I'm glad progress is being made. Is it likely to have improvements done by the  
end of the 12th month of this fee?  
Moermond: That is possible. If it was done next week that would still put it in the  
program for 11 of 12 months.  
Yang: Could we knock that one month's worth of payment off the fee?  
Moermond: Council has discretion in this matter.  
Yang: I would prefer to do that. If it's not done then, I would like to spread payments  
over 5 years.  
Council President Noecker: So you move to prorate the amount if they're done before  
the 12 months are up, and if not, to make the full amount payable over 5 years?  
Yang: Yes.  
Moermond: Based on the course Yang would like, I would recommend to actually refer  
this back to Legislative Hearing on May 6, 2025, so we could review progress and then  
come back with an amended version.  
Yang: I support that and move that referral.  
Councilmember Kim: I support that, and situations like this are why we need more  
nuance in our vacant building policies, especially when it comes to fires.  
Noecker: This has been an issue and we are working on that policy change.
