structure. He discussed making a facade to give that building-like appearance. I
worked with the Building Official, and these are not considered buildings under state
building code. It is not within the purview of the Council to determine that this can be
considered a building. What's before you is an appeal of the Property Maintenance
Code, Chapter 34, which states that it's in violation of the Stored Materials section of
the exterior residential code. The question is about when is compliance required.
Compliance could come by way of the Building Official granting a waiver allowing it to
be considered a building under certain conditions. If there's disagreement there, that
could go to the state under an appeal to them. Back to what's before you, this is
definitely an intermodal storage container in violation of Chapter 34. The question is
what should be established as a deadline for removal. I am recommending a deadline
of January 1. This item was delayed for a while to pair it with a vacate order on the
property, and I want to separate this out while we deal with those other issues.
Jerry Brashier: I'm requesting for the container to remain while open work requirements
by the City are in progress. I've done a lot of work on the property to improve the
neighborhood. The City recognizes the need for storage containers as outlined in the
storage container permit application. That said, no permit is required when the
container is completely on private property. This one is. It's been there for a while, but
I've been making improvements during this time. It was moved briefly, but has been
brought back. I currently rent it. It does not block any exits or traffic. If this request is
not allowed, I am asking if I can turn it into a movable shed. It's 200 square feet, the
legal amount for a shed. I can turn it into whatever you like. I've done this for
Minneapolis public housing.
Council President Jalali: What is your ask?
Brashier: Can I keep the container while there are open work permits?
Councilmember Noecker: What is the connection between the work and the storage
container? You're keeping tools there?
Brashier: Correct.
Noecker: I'm not comfortable allowing it to be there until permits are finaled. That
could be a long time. What is the period of time you anticipate for completing the
work?
Brashier: I'm not sure. I'm contacting structural engineers and looking to hire one to
see what needs to be done. On October 25, there was a fire inspection that flagged
the foundation, brick, deck, walls, metal coping, tuck pointing, and repointing. So,
almost the entire building, which is silly. It's not a horribly dilapidated building. That's
why I hired a structural engineer for that assessment.
Noecker moved to close the public hearing. Approved 6-0.
Noecker: I will need some time. It makes sense to allow it there for work being done,
but I also want to keep things moving along. I move a one week layover.
