Marcia Moermond, Legislative Hearing Officer: Orders were written for removal of a  
desk that is shown on the screen. It got moved, but just around the corner. In  
Legislative Hearing, the person noted she was busy and gave a lot of reasons for why it  
wasn't moved. These reasons included COVID, traveling, and other things. I can’t  
recommend deletion or reduction of an assessment based on those factors. The work  
was done, and this is the cost of doing the work and sending it to assessment.  
Rachel Frazlin: I was ignorant of the law because my deceased husband managed the  
property. I can’t lift more than 10 pounds due to back pain. I hired two people to move  
it behind my fence, fully expecting that it would get picked up by people who scour the  
neighborhood for free furniture. I didn’t see the second notification. I'm managing my  
household alone with a disabled son, working as nurse practitioner, and dealing with  
other things. This ordinance drives our aging population to leave the city. This prevents  
elderly people from staying in their homes.  
Councilmember Bowie moved to close public hearing. Approved 6-0  
Council President Jalali: What are the options for payment over time in this situation?  
Moermond: It could be made payable over 4 years.  
Jalali: How would that work?  
[Moermond described the assessment process]  
Jalali: I will recommend payment over time and connect you with the Hamline Midway  
Coalition to see if they can help. I understand your situation.  
Moermond: I will amend the resolution to make it payable over 4 years.  
Jalali: I will move that.

Councilmember Noecker: I support Jalali's motion. Our garbage contract also includes

Marcia Moermond, Legislative Hearing Officer: This property has been in the Vacant  
Building Program since December 27, 2021. The vacancy initially resulted from a fire  
and a death on the property. What is before you is the December 27, 2023 –  
December 26, 2024 Vacant Building Fee. 7 months in, if we had finaled permits, I  
might have recommended pro-rating the fee down to 6 months. 4 permits remain not  
yet finaled. I met with the owner and attorney in the hall. This was our second  
conversation, the first being in the Legislative Hearing. Their ask is to show grace to  
continue to the matter for 5 weeks to September 11.  
Brad Egan: Mike Mortimer has owned this property for 45 years. Mortimer was a union  
electrician and fixed a lot of problems with the property himself. Three days before  
Christmas in 2021 there was a fire, resulting in Mortimer's stepson being killed. He  
signed a repair contract while dealing with the remorse of the incident, and then had to  
spend a lot of time fighting the contractor, who gutted the property instead of just  
dealing with the part that was fire-damaged. A lot of Mortimer's improvements were  
taken out. He rented it and always had good tenants. There were then issues with the  
mortgage company and insurance company, which are now resolved. He's also had  
heart issues which have slowed him down as the primary contractor.  
Council President Jalali: What is your ask?  
Egan: We want another 5 weeks to complete the work before Council again considers  
this fee.  
Jalali: What is the hope for what will happen in that time?  
Egan: Mortimer will complete the electric work. He is not just repairing. He is improving  
the property. I have photos to share as well. On the screen you can see the  
high-quality work.  
Councilmember Noecker moved to close the public hearing approved 6-0.  
Jalali: What would extra time mean for the resolution before us?  
Moermond: I ask that the amount be prorated based on the continued amount of time.  
I also ask that if the work is still not completed that the assessment should be  
ratified.  
Jalali: I would like to do that.  
Councilmember Jost: I support that motion.  
Councilmember Johnson: Could you explain the prorating?  
Moermond: We will update the percentage of the assessment that is to be paid based  
on how long the building will have been in the vacant building program. If the building  
end up having been in the program for 9 of the 12 billed months, Council could prorate  
the assessment proportionally.  
Johnson: I support that motion.  
Councilmember Yang: I'm sorry for your loss. I support the motion. I hope you take  
advantage of this extra time  
Jalali: The motion again is to lay this over to September 11, and update the prorating  
of the assessment accordingly if the work is done.

Appeal of Steven R. Schwartz to a Vacant Building Registration Notice at  
1105 PAYNE AVENUE.

Marcia Moermond, Legislative Hearing Officer: This is a property that had its Fire  
Certificate of Occupancy (FCO) revoked. The main level was a mercantile use in the  
past and inspected as such. The second floor was apartments. It doesn't appear the  
basement was previously rented. The owner rented the main level and the basement to  
a tenant who used is as an assembly space. This was likely done with the owner's  
understanding, as he makes frequent trips to the property. The assembly use would  
require adequate exiting, bathrooms, door width, and other things. There were also  
unlicensed liquor sales being done, with paper signs for drink costs and where to send  
the money in Cash App. This building was not designed for this purpose. The FCO was  
revoked, the tenants moved, and the property was sent to the Vacant Building Program  
not long after. This is an appeal of that Vacant Building Registration. The owner did not  
want to be in the program, and about 20 minutes into the hearing after some attempted  
problem solving and suggested modifications, the owner left the hearing and we could  
not come to a conclusion on the record. Therefore my recommendation is to deny the  
appeal.  
Cindy Schwarz: We don't understand why this property is vacant. We always have  
tenants, and changeover always results in empty space. That doesn't mean it is  
vacant. Secondly, we don’t know why this property is condemned. We never saw those  
photos Moermond showed or any structural issues. We just got this condemnation  
letter and no notification from inspectors or police beforehand. These bikers put us on  
the middle of this situation. Also, how can you send a condemnation and send it to the  
Vacant Building Program on same day? That’s not supposed to happen. People were  
also discussing case without husband present at the property. This is why we as  
landlords have no rights. Police never notified us of gang activity or alcohol sales.  
Council President Jalali: What is your ask?  
Schwarz: We want off the Vacant Building list and the fees removed. We want to paint  
it and sell it.  
Steve Schwarz: Unlike Moermond said, the condemnation and the vacant status  
happened on the same day. I'm also wondering if all those officers always show up on  
a first inspection.  
Councilmember Yang moved to close the public hearing. Approved 6-0.  
Yang: What are some other examples of things that took place beyond the alcohol  
sales?  
Moermond: A notice went out on June 14 to owner with a correction notice stating that  
the business was not being used correctly and had a reinspection date of June 20.  
Orders were written then and another reinspection was done on June 28, when it was  
referred to the Vacant Building Program. Vacant Building file was opened on July 3.  
Schwarz was present during the inspections when information was provided. During an  
effort to explain the situation, he left abruptly but did return. I don't know what other  
discussions happened besides that. To the point about staff present for the  
inspections, I can't speak to that. I can only say that the Department of Safety and  
Inspections (DSI) and Police make those decisions as they see fit. I Legislative  
Hearing, those present aside from me and my staff were the inspector who wrote the  
orders, the manager for the inspection area, one of the officers present at the  
inspection, and a subordinate from the police commander who wanted to attend but  
was unable to. If there were conversations outside of the hearing, I wasn't there.  
Yang: Assembly use would require a lot of changes like you mentioned, for fire safety.  
This seems like a proper fit for the building. They should continue conversations to  
pursue this use.  
Moermond: The entire building is not condemned. Ordinance does allow for a portion of  
building be condemned. The upper floors are not condemned.  
Councilmember Noecker: A similar situation happened in my ward. What would be  
needed to remove the Vacant Building status?  
Moermond: It depends on the use. Mercantile or assembly use would need a new code  
complaint plan with building permit applications and approved final inspections.  
Sufficient degradation has taken place so I think that is necessary.  
Noecker: With this being just one month in, is it possible they could get this done  
quickly and have things prorated?  
Moermond: It's possible. In this case, the hearing ended before I could discuss those  
options.  
Noecker: It seems like it’s in the owner’s interest to talk with you and get this resolved  
as soon as possible.  
Yang: I move Moermond’s recommendation  
Councilmember Bowie: Could you clarify what the recommendation is?  
Moermond: To deny appeal and have the space registered as a Vacant Building. The
