Councilmember Jost asked about the difference between the fine and suspension  
penalties.  
Skarda stated that the suspension was for serving liquor without liquor liability  
insurance, and the fine would be for not submitting the required management  
agreement to the Department of Safety and Inspections (DSI). Because they usually  
don't double-up on penalties, DSI only recommended the greater penalty of a  
suspension.  
Councilmember Noecker suggested picking the dates of the suspension.  
Skarda encouraged councilmembers to pick the dates, to help get the suspension  
served promptly.  
O'Neill suggested dates for the suspension.  
Councilmember Johnson expressed concern with letting a licensee pick suspension  
dates.  
Jalali suggested an amendment to reduce the suspension to 5 days on March 18, 19,  
20, 25, and 26, and set a fine of $1000.  
Councilmember Bowie spoke in support of Jalali's amendment.

Also in attendance: Francisco Ochoa, appellant (remote attendance, translated  
through in-person interpreter)  
Marcia Moermond, Legislative Hearing Officer: This is an assessment for garbage  
hauling from July 1 to September 30, 2023. When the garbage bill went unpaid, the  
unpaid bill was sent to the City as an assessment. The amount is $119.89. In  
Legislative Hearing, Ochoa said he was appealing due to a lack of income, not  
because of an allegation that services were not provided.  
Francisco Ochoa: That is correct.  
Moermond: Ochoa said he also had medical difficulties and was waiting for his green  
card, further complicating things.  
Ochoa: That is correct. I am unable to work due to disability and have been unable to  
do so for the last 3 years.  
Council President Jalali: Are you finished with your staff report, Moermond? I'd like to  
know if you have any additional points to make so that we can let Ochoa know we will  
hear from him after you're finished.  
Moermond: I just have two more things. First is that he stated in Legislative Hearing  
that he was previously getting financial assistance in paying his bills, including his  
property taxes (which are up to date). Secondly, if there is difficulty in paying property  
taxes, Ramsey County has mechanisms to help like payment programs. He has a long  
period of time to catch up on property taxes.  
Ochoa: I have a medical disability. I'm waiting for my green card. I've been receiving  
financial assistance but that is not enough. I've been trying to pay all my taxes, but  
when the pandemic started I got sick, a brother died, and I've had 9 surgeries since  
then. I have a brain tumor, my feet are numb, and I just had hip surgery. With these  
limitations, can't work and have no income. I'm retired. I have social security, but that  
has been on hold because I started my process to obtain a green card for permanent  
residency. All my assets are now frozen, including my social security. My lawyer has  
been asking for an extension with immigration, but I don't have insurance and am  
having trouble getting medications. I've also been having difficulty eating. I've been  
working here since 1986 after arriving in 1970. I'm not a new immigrant. All my money  
was put into social security but now it's all frozen. I've been paying a lot of taxes for a  
long time. I have two applications for immigration. One is in California and one in is  
Minnesota. I did have Social Security money, but once permits for work stopped last  
May, I have not had money coming in. It was supposed to go for one more year, but I  
have not received it.  
Councilmember Johnson moved to close the public hearing. Approved 7-0.  
Councilmember Yang: Thank you for being here Francisco, and thank you for the  
translation as well. We’ve talked about how cost-burdened families are a lot. Many  
families struggle to pay garbage bills. I think this also intersects with why I am  
supportive of cart-sharing and opt-out options for garbage hauling, to avoid or reduce a  
cost burden. Moermond, are there services that could assist the appellant, and could  
you also restate your recommendation?  
Moermond: My recommendation is to ratify the assessment. I cannot look at financial  
circumstances like financial difficulties in developing my recommendation.  
Noecker: Is there an opportunity for deferral of payment, especially since this person is  
a senior?  
Moermond: There are no assessment deferrals for nuisance abatement assessments  
or garbage assessments like this. Regarding resources to help, I don’t know of any  
resources to help pay property taxes.  
Jalali: Comunidades Latinas Unidas en Servicio (CLUES) may be able to help as a  
starting point, if any programs exist. They could help point Ochoa in the right direction.  
Moermond: While there may not be assistance to help with this assessment, there  
may be assistance in other areas. There are food shelves and other support services  
that I don’t work with every day that could help him.  
Noecker: I’m comfortable with the recommendation. I don’t see a legal basis for doing  
otherwise. For ongoing garbage bills, what tools are there if he is still creating  
garbage?  
Moermond: There are some tools. The bill before you today is for a larger container.  
We worked in hearing to get him into a smaller semi-weekly container which is  
cheaper, though this may not be enough to handle his garbage. We also set up  
walk-up service, which is ongoing.  
Yang: When would the recommended $119.89 be due with property taxes?  
Moermond: It would appear on 2025 property taxes, with half due in the first half of the  
year and half due in the second half of the year.  
Yang: I support Moermond’s recommendation. My office will follow up with Ochoa and  
connect to community organizations to help him get unstuck. I sit on the Water Board,  
and I know with water bills, people can make contributions to help out other customers  
in need. I will talk with Public Works Director Kershaw about doing that for garbage. I  
move approval. I would like Ochoa to be on the lookout for my staff reaching out. I  
appreciate his vulnerability in sharing his story.
