LEGISLATIVE HEARING DISCUSSION ITEM
Ordering the removal of the structures at 1600 SEVENTH STREET WEST
45
within fifteen (15) days after the August 24, 2022, City Council Public Hearing.
(Public hearing continued to January 11, 2023)
Marcia Moermond, Legislative Hearing Officer: I am asking that the City Council refer
this back to Legislative Hearings for March 14th. I would also like the Council to note
that it is doing so with the understanding that the owner will bring the sign (which has a
zoning order on it for its removal) into compliance by June 30th. That would make the
order to remove the sign and the order to remove the buildings (which is in front of you
right now) happen together. That just made sense. We worked with the Zoning
Manager at the Department of Safety and Inspections to have that done. I would also
note that I have worked with the attorney representing Burger King, and this is some
fabric covering the corporate logo sign and it's off on one side. We have required that
the fabric be repaired or replaced by the end of this month, which would have been the
deadline of the zoning enforcement letter. Just wanted to put those two items in sync
and note that for the record.
Tolbert moved approval.
Referred to March 14, 2023 Legislative Hearing, noting compliance with
December 27, 2022 Zoning Enforcement Notice is required by June 30, 2023.
