Marcia Moermond, Legislative Hearing Officer: Council asked me to follow-up on this  
item. The owner testified that they had a conversation with a Fire Inspections Manager  
about this case. There was an arson that first brought the Fire Department, and then  
the Police Department. Restoration Professionals, the City boarding contractor, then  
arrived along with staff from the Department of Safety and Inspections. Fire turned the  
scene over to them. The Fire Inspections Manager talked with the owner, and there  
seems to be a miscommunication. By the time the owner showed up, 4 doors had  
already been screwed shut. That is what the invoice indicates. The conversation was  
also about securing the windows, and the owner was told that if they did it themselves  
then there would not be a charge for the City doing that work. The owner was given  
additional time to get that done, and did so with their own boards. The invoice for  
screwing the doors shut is valid, though.  
Councilmember Yang: I appreciate you looking into this and move the  
recommendation of the Hearing Officer. Moermond, please convey that to the owner.

Marcia Moermond, Legislative Hearing Officer: Last time this was before Council, you  
asked two questions. First: How was the Homeless Assistance Response Team  
(HART) involved in the homeless encampment cleanup, and what was the nature of the  
items cleared as part of the summary abatement order being assessed. I talked with  
Department of Safety and Inspections (DSI) Deputy Director David Hoban and Code  
Enforcement Supervisor Lisa Martin about this. They said that HART was there in early  
April to clear the encampment, working with police to help people take their tents,  
bedding, and materials. The occupants were the ones who removed the items, not a  
City crew. I was wrong in earlier stating that a City crew took items away. City staff  
merely partnered people there to get them to remove their own items. The cleanup  
being assessed was for two trailers full of garbage and scattered garbage throughout  
the site. DSI viewed those items as distinct and as being connected to the owner or  
tenant of the space. They did not associate the items with the encampment, and  
orders were written to remove the items two weeks later. My recommendation remains  
unchanged, which is to ratify the assessment.  
Council President Noecker: Last time, I asked about the history of the property. Were  
we able to get that information?  
Moermond: Before the Legislative Hearing in June, we looked at the property history.  
That history includes:  
-Dumping in 2023, cleaned up by the City.  
-Snow removal in January of 2023, cleaned up by owner but an excessive consumption  
bill was sent for inspectors having to repeatedly go out there.  
-Dumping in 2022, which was sent to Public Works, so there was probably a  
right-of-way connection, maybe on the alley-facing side.  
-Additional garbage and dumping occasions in 2022 and 2021.  
I see that the City often issues orders a couple times a year for this property to keep it  
maintained. The owner seems to take care of most things, and dumping tends to  
come in at least once a year as an issue getting complained about to the City.  
Councilmember Bowie: I move the recommendation of the Hearing Officer. We can  
look in the future at how to best communicate the process of cleaning up homeless  
encampments to property owners.
