Marcia Moermond, Legislative Hearing Officer: This is an assessment for a property  
cleanup stemming from a homeless encampment. The City removed the larger items  
like tents but issued a summary abatement order for the smaller things left behind like  
trash. The order was issued on March 19, 2025. Cleanup was not done by the  
compliance date of March 26, and a work order was put in which was done on April 7.  
The cost is for 1 hour of work, plus a charge for the materials a service charged. The  
total is $669.  
Hue Tran: I want to state the correct address, which is 427 Aurora Ave. The letter I  
received on March 19 included a photo that was not of my property. There are two more  
photos. One is of my property, but the other is owned by a liquor store. This photo  
should not be under my name. This cleanup should not be charged to me. The  
homeless people behind the property made more trash for me to clean up. I was told  
messages were left for me, but I did not receive them. My property is my responsibility  
to clean up, but those pictures are not my property. If you include it all together, I will  
not pay. I will only pay for my portion.  
Councilmember Kim moved to continue the public hearing to August 27.  
Moermond: That was what Councilmember Bowie wished for, which was communicated  
through her legislative aide. I can also provide follow-up information to things that were  
said today.  
Councilmember Johnson: Are we able to confirm the property lines?  
Moermond: Yes. We reviewed that in Legislative Hearing using aerial maps and I want  
you to have that info before you make a decision.

Ashley and Bradley Taylor, property owners, appeared in person  
Marcia Moermond, Legislative Hearing Officer: This is an unusual circumstance  
amending a previously ratified vacant building assessment that has been certified to  
property taxes for 2025. Any reduction adopted by Council would come in the form of a  
refund. We needed to investigate a possible error in Legislative Hearing. This was a  
registered vacant building since 2019. There used to be two buildings on the parcel.  
One was knocked down. The other continued to exist without a use as a vacant  
building. It needed to be fixed and get its Fire Certificate of Occupancy (FCO) back,  
and the changes the owner wanted also required a change in use. In 2022, there was  
work on the property done without permits. The Department of Safety and Inspections  
(DSI) spoke to the owner about that. In February 2024, the Change in Use documents  
were submitted to DSI. The vacant building file was closed in March. In the normal  
course of events, I would ask Council to consider prorating the assessment. The bill  
was from October 2023 through October 2024 and the building was out in March at 6  
months in. Was a mistake made? My finding is no. To treat it as similar cases to  
those that are timely, you could prorate this amount as a refund, which is my  
recommendation.  
Ashley Taylor: We did not own the building until halfway through 2023. We got letters  
about this, and each time we got one we called, texted, or showed up in-person to DSI.  
We were told repeatedly that the letter was a mistake by Clint Zane, Nathan Brune,  
and Matt Dornfeld. We did everything we could and were told to ignore the letter. There  
may have been confusion. Maybe the inspectors weren't out there in-person and  
weren't aware. We were told this was a mistake within the system and that it would be  
pulled off 6 or 7 times. We trusted the inspectors and then saw this $5,000 bill on our  
taxes two years later in 2025. We would not have just ignored this bill. We developed  
this property as a community garden under the Hamline Ave bridge.  
Councilmember Kim: What is your ask?  
A. Taylor: We want the entire bill removed, since that was what we were told would  
happen in 2023.  
Kim: Because Councilmember Bowie is out, I will move to continue the public hearing  
for three weeks.

Adam Dullinger, property owner, appeared in person  
Marcia Moermond, Legislative Hearing Officer: An order to remove tall grass and weeds  
was issued automatically after a complaint came in. These are not investigated before  
an order is issued. Three days later and inspector goes to check, similar to snow  
shoveling. There was an appeal to say that it was not tall grass and weeds but rather  
an intentional pollinator garden. There was testimony that the owner had invested  
$3,000, perhaps $4,000, on it. Over the course of the hearing, I developed a  
recommendation that Council grant the appeal. Unfortunately, three days after my  
recommendation, contractors were dispatched to cut the grass and it was all mowed  
down. I will try to pull up a photo for you.  
Adam Dullinger: I had my whole yard redone as a pollinator garden 4 years ago. This is  
extremely disheartening. My recommendation is that this part of the ordinance needs to  
change. This should not be automatic. This violates state law that allows native  
landscapes that exceed 8 inches. It's kind of just up to the inspector to decide if they  
think it's native, and that isn't right. I don't have a say if my neighbors complain and  
that's a burden on me. This is the first year we really saw seedlings from our tree  
coming out.  
Councilmember Kim: Do you have any change to Moermond's recommendation?  
Dullinger: No.  
Kim: We still need to vote even though the work happened?  
Moermond: It would be good to create a record indicating that Council found this not to  
be an overgrown turf lawn. State law does provide for this type of planting.  
Kim: I move to approve this appeal.  
Councilmember Johnson: The issue was not the ordinance but rather the process  
where the issue wasn't put on hold upon appeal. What happened?  
Moermond: Code says that enforcement is stayed for the duration of an appeal, with  
some exceptions for things like emergency vacate orders with imminent safety  
concerns where I can make temporary decisions. That did not happen here. DSI staff  
were in the Legislative Hearing. I think there was a communication issue between the  
DSI person staffing the room, the person who sends out work orders, and the person  
who oversees the work crews, which could be three different people. This is a first for  
me with this happening.  
Johnson: This is slightly concerning and if there's a pattern of this we need to discuss  
it further.
