Approving adverse action against all licenses held by Peter P. Ratsamy, d/b/a 88 Oriental Foods at 291 University Avenue West.
 
Body
WHEREAS, adverse action was taken against all licenses held by Peter P. Ratsamy d/b/a 88 Oriental Foods (License ID #20050001541) for the premises located at 291 University Avenue West in Saint Paul by Notice of Violation dated September 30, 2011, alleging that during a re-inspection on September 12, 2011, a DSI Inspector cited the licensee for the same Critical-Major Environmental Health Code violation that had not been corrected by the August 28, 2011 deadline; and
 
WHEREAS, per Saint Paul Legislative Code ยง 301.05 (m) (9), the licensing office recommended a $250.00 matrix penalty and suspension of licenses until the violation is corrected; and  
 
WHEREAS, the licensee did respond to the Notice of Violation to request a public hearing which was held on November 2, 2011; now, therefore, be it
RESOLVED, that all licenses held by Peter P. Ratsamy d/b/a 88 Oriental Foods are hereby suspended and the licensee is ordered to pay a $250.00 matrix penalty for failure to correct the Critical-Major Environmental violation cited during a re-inspection on September 12, 2011.   Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.  
  
This resolution, and action taken above, is based upon facts contained in the September 30, 2011, Notice of Violation sent to the licensee and the arguments made at the public hearing on November 2, 2011.
