Approving adverse against the Taxicab Driver license held by Osman Sed Elmi, d/b/a Osman Sed Elmi.

WHEREAS, adverse action was taken against the Taxicab Driver license held by Osman Sed Elmi d/b/a Osman Sed Elmi (License ID #20070003723) for the City of Saint Paul by Notice of Intent to Revoke License dated September 15, 2011, alleging licensee's Minnesota driver's license was revoked by the Minnesota Department of Vehicle Services (DVS) for ninety (90) days on May 21, 2011 for "Alcohol Concentration .08 or More" in violation of Minn. Stat. § 169A.20, Subd. 1 and Saint Paul Legislative Code §376.16 (e) (5) (a) (2); and
WHEREAS, the licensee applied for a renewal of his Taxicab Driver license within one (1) year of this license revocation in violation of Saint Paul Legislative Code § 376.16 (e) (5) (b); and
WHEREAS, as a result of this violation, the licensing office recommended license revocation; and
WHEREAS, the licensee did respond to the Notice of Intent to Revoke License to request a public hearing which was held on November 2, 2011; now, therefore, be it
RESOLVED, that the Taxicab Driver license held by Osman Sed Elmi d/b/a Osman Sed Elmi is hereby revoked.
This resolution, and action taken above, is based upon facts contained in the September 15, 2011, Notice of Intent to Revoke License sent to the licensee and the arguments made at the public hearing on November 2, 2011.
