Approving a technical change to vacation resolution RES PH 11-933 to direct conveyance of Gordon Square to Petitioner via the HRA.

WHEREAS, on June 1, 2011 the City Council approved RES PH 11-933, attached hereto as Exhibit A, that in part authorized the disposal of a 3,485 square-foot parcel of city parkland named Gordon Square; and
WHEREAS, the resolution directed that the parcel be conveyed to Sara Billings, LLC, the Petitioner and owner of the residential property at 35 Langford Park located immediately westerly of and adjacent to the Gordon Square property; and
 
WHEREAS, Section 51.01 of the Administrative Code, Disposition of City Property, permits the City to dispose of property directly to a private party under certain circumstances, but such circumstances are not applicable to the Gordon Square disposal; and
WHEREAS, Section 51.01, Paragraph 11 permits disposal of city property to the Housing and Redevelopment Authority of the City of Saint Paul ("HRA"), which in turn may, with proper authorization, dispose of the property to a private party; now, therefore be it
RESOLVED, that the final paragraph of RES PH 11-933 is hereby amended with the following addition:
    "RESOLVED, that the proper city officials are hereby authorized and directed to convey via quitclaim deed said Park Property to the Housing and Redevelopment Authority for subsequent conveyance to said Petitioner, and to accept just compensation from said Petitioner in the form of cash to be deposited into the Parkland Replacement Fund and held in reserve for future purchase of park property as required in Chapter 13.01.1 of the City Charter; and that all fees required by the City to comply with its parkland diversion guidelines shall be fully compensated by said Petitioner."

RESOLVED, that all other provisions and conditions of RES PH 11-933 shall remain in full force and effect.
