WHEREAS, in the matter of the Appeal of Aaron Durkop, on behalf of K.C. Rabobank, to a Revocation of Fire Certificate of Occupancy and Order to Vacate at 604 HOLLY AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
 
WHEREAS, the Legislative Hearing Officer recommends that the City Council deny the appeal on the tuckpointing, stair repair or replacement and parking lot repair or replacement, requiring that repairs be made under permit and signed off by September 16, 2011, or in the alternative complete replacement by October 31, 2011; Now, Therefore, Be It
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
