Purpose of Appeal
Appealing four double-hung and two gliding window replacements that will not comply w/ St. Paul Uniform Egress Policy.  Double-hungs are short in openable height but exceed all other criteria.  Gliding windows will be short in openable width but exceed all other criteria.  Please approve.

Yes, 1 inch variance in the opening height of the double hung windows, and a 2 inch variance in the opening width of the openable width.

WHEREAS, in the matter of the appeal of Renewal by Andersen, on behalf of Elizabeth and Paul Chmelik, to an Egress Window Non-Compliance Determination at 1226 BERKELEY AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
 
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant a 1-inch variance on the openable height of four double hung replacement egress bedroom windows measuring 23.125 inches high by 28 inches wide, and grant a 2-inch variance on the openable width of two slider replacement egress bedroom windows measuring 44 inches high by 18 inches wide; Now, Therefore, Be It
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
