Title

Approving a Temporary License Agreement between the City of Saint Paul Police Department and Shidler/West Finance Partners for the Department's use of a parking lot for the temporary relocation of the City Impound Lot

 

Body

WHEREAS, the Saint Paul Police Department ("SPPD"), on behalf of the City of Saint Paul ("City"), is considering relocating staff and vehicles in the City police impound lot located at 830 Barge Channel Road in Saint Paul ("Impound Lot"), and within the MIssissippi River floodplain, in the event that river levels rise sufficiently to flood the Impound Lot yard; and

 

WHEREAS, SPPD has identified a large, paved parking lot on property located at 235 Maryland Avenue East in Saint Paul ("Shidler Property"), which is the customer parking lot of the former K-Mart store ("K-Mart Lot") and has contacted the Shidler Property owner to request the use of the K-Mart Lot for approximately 30-60 days, depending on flood conditions, to establish a temporary impound lot to store 300-400 vehicles until the Impound Lot is once again available for use; and

 

WHEREAS, Owner has agreed to SPPD's use of the K-Mart Lot and has drafted a license, attached hereto as Exhibit A ("Temporary License"), to document the conditions of SPPD's use of the K-Mart Lot, including a license fee; and

 

WHEREAS, Owner is requiring the City to indemnify Owner for any loss, theft, or damage to persons or vehicles in the K-Mart Lot; and

 

WHEREAS, SPPD and Owner mutually desire to enter into the Temporary License, but only in the event of a flood requiring the temporary relocation of staff and vehicles from the Impound Lot; now, therefore, be it

 

RESOLVED, that the City Council hereby authorizes the proper city officials, in the event of a flood requiring said relocation of the Impound Lot, to execute said Temporary License, in a form and content substantially as set forth in Exhibit A attached hereto.
