Final Order to approve the construction of the Capital City Bikeway Project and acquisition of necessary property rights.

Body
IN THE MATTER OF constructing the Capital City Bikeway Project, including a bicycle trail, traffic lanes, public utility work, parking lanes, street lighting, trees, signs, concrete sidewalks, and acquisition of temporary construction easements needed to facilitate construction of the improvements.

The improvements and temporary construction easements are depicted in Exhibits A1-A3 attached hereto.

Under Preliminary Order (RES 22-841) approved June 8, 2022

WHEREAS, the Council of the City of Saint Paul has conducted a public hearing upon the above improvements and acquisition, due notice thereof having been given as prescribed by the City Charter; and

WHEREAS, the Council has heard all persons, objections and recommendations pertaining to said proposed improvements and acquisition and has fully considered the same; now, therefore, be it

RESOLVED, that the Council of the City of Saint Paul does hereby order that the above-described improvements be made, and the proper city officers are hereby directed and authorized to proceed with the improvements; and be it further

RESOLVED, that the Council hereby determines the real property rights required for these improvements to be temporary construction easements, as described above and depicted in Exhibit A3, and the proper City officers and City Attorney are hereby authorized and directed to take all actions necessary to acquire said real property rights by direct purchase; and be it finally

RESOLVED, that the proper City officers submit a report to the City Council for the purpose of the Council’s making an award of damages, as needed, for the rights acquired on said real property.
