Approving a Liquor Off Sale and waiving the three-hundred (300) foot separation distance requirement from a protected use in order to issue a Liquor Off Sale license to Life is Grand LLC d/b/a The Little Wine Shoppe (License ID #20210002156) at 2305 Como Avenue.

Body
WHEREAS, Life is Grand LLC d/b/a The Little Wine Shoppe (License ID #20210002156) applied for a Liquor Off Sale license for the premises located at 2305 Como Avenue in Saint Paul and requested a waiver of the three-hundred (300) foot separation distance requirement from a protected use as outlined in Saint Paul Legislative Code § 409.06 (i) (3) in order to issue a Liquor Off Sale license; and


WHEREAS, the licensee sought support from a list of private residences, dwellings and apartment houses within 300 feet of the proposed Liquor Off Sale license location at 2305 Como Avenue that was provided by the Department of Safety and Inspection by signatures of approval on petitions; and


WHEREAS, the licensee was able to obtain thirty-one (31) of forty-one (41) possible signatures from nearby residential properties for seventy-five percent (75%) support; and


WHEREAS, in response to the January 10, 2022, notification from the Department of Safety and Inspections regarding the license application, the City received no objections to the Liquor Off Sale license; and

WHEREAS, the Council finds that issuance of the license will not interfere with the reasonable use and enjoyment of neighboring property and residences and will not bear adversely on the health, safety, morals, and general welfare of the community; and


WHEREAS, the Council finds that the license conditions are reasonable given the license applied for, the application is in order and there are no grounds to deny approval of the license; now, therefore, be it,
