TITLE

Authorizing the City of Saint Paul to apply to Minnesota Department of Employment and Economic Development Contamination Cleanup Grant funding for 176 Robert Street South and Saint Paul City School (215 University Avenue) sites.

 

BODY

WHEREAS, the City of Saint Paul act as the legal sponsor for the projects, 176 Robert Street South and Saint Paul City School (215 University Avenue West), contained in the Contamination Cleanup Grant Program applications to be submitted on November 1, 2021, and that Mayor and City Clerk are hereby authorized to apply to the Department of Employment and Economic Development for funding of these projects on behalf of City of Saint Paul; and

WHEREAS, the City of Saint Paul has the legal authority to apply for financial assistance, and the institutional, managerial, and financial capability to ensure adequate project administration; and

WHEREAS, the sources and amounts of the local match identified in the application are committed to the projects identified; and

WHEREAS, the City of Saint Paul is located within the seven-county metropolitan area defined in section 473.121, subdivision 2, and is participating in the local housing incentives program under section 473.254; and

WHEREAS, the City of Saint Paul has not violated any Federal, State or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice; and

WHEREAS, that upon approval of its application by the state, the City of Saint Paul may enter into a grant agreement with the State of Minnesota for the above referenced projects, said agreement containing defense and indemnity obligations; and

WHEREAS, the City of Saint Paul certifies that it will comply with all applicable laws and regulation as stated in all contract agreements; now, therefore, be it

RESOLVED by the City of Saint Paul, through the Saint Paul City Council, as follows:

1.                     The City hereby approves and authorizes the Contamination Cleanup grant application to be submitted to the Department of Employment and Economic Development on November 1 2021, by the City of Saint Paul for 176 South Robert Street and Saint Paul City School (215 University Avenue West) sites.

2.                     The City hereby authorizes the Mayor/Deputy Mayor, the Director of the Office of Financial Services, and the Director of Planning and Economic Development to execute a grant agreement with the State, containing defense and indemnity obligations, on behalf of the City.
