Approving the application of Irish Fair of Minnesota for a sound level variance in order to present amplified sound on August 12 through August 15, 2021 at 200 Dr. Justus Ohage Boulevard - Harriet Island.

WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in the City of Saint Paul; and
WHEREAS, §293.09 provides for the granting of variances from the sound level limitations contained in §293.07, upon a finding by the City Council that full compliance with Chapter 293 would constitute an unreasonable hardship on the applicant, other persons or on the community; and
WHEREAS, Sarah Van Sickle, Executive Director, who has been designated as the responsible person on the application, has applied for a sound level variance at a requested level of 100 dBA measured at 75 feet, to present amplified sound. Proposed times of operation are from 3:00 p.m. to 10:00 p.m. August 12, 10:00 a.m. to 11:00 p.m. August 13, 8:00 a.m. to 11:00 p.m. August 14 and 8:00 a.m. to 8:00 p.m. August 15, 2021 at 200 Dr. Justus Ohage Boulevard - Harriet Island; and
WHEREAS, if applicant is not granted the variance, applicant will not be able to present the outdoor amplified sound at 200 Dr. Justus Ohage Boulevard - Harriet Island; and
WHEREAS, the Department of Safety and Inspections (DSI) has reviewed the application and has made recommendations regarding conditions for the variance. Now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Irish Fair of Minnesota, subject to the following conditions:
1) The Variance will be for a music series starting at 3:00 p.m. to 10:00 p.m. on Thursday, August 12, 10:00 a.m. to 11:00 p.m. on Friday, August 13, 8:00 a.m. to 11:00 p.m. on Saturday, August 14 and 8:00 a.m. to 8:00 p.m. on Sunday, August 15, 2021, for the Irish Fair of Minnesota at 200 Dr. Justus Ohage Boulevard - Harriet Island.
